Transfer of Business (Protection of Employment) (Amendment)

Regulations, 2010

IN exercise of the powers conferred by article 48 of the

Employment and Industrial Relations Act, the Prime Minister has

made the following regulations

The title of these regulations is the Transfer of Business

(Protection of Employment) (Amendment) Regulations, 2010

and they shall be read and construed as one with the Transfer

of Business (Protection of Employment) Regulations, 2002,

hereinafter referred to as “the principal regulations”.

In paragraph (b) of sub-regulation (2) of regulation 3 of

the principal regulations, for the words “vessels.” there shall be

substituted the words “vessels:” and immediately thereafter there

shall be added the following proviso

“Provided that article 38 of the Act and these regulations

shall apply in respect of employees whose conditions of

employment are regulated by the Seamen Wages Council

Order and by the Seamen Wages Council Wage Regulation

Order.”.
