PLANT QUARANTINE ACT

(CAP. 433)

Plant Quarantine (Harmful Organisms) (Amendment) (No. 2)

Regulations, 2010

IN exercise of the powers conferred by article 32 of the Plant

Quarantine Act, the Minister for Resources and Rural Affairs has

made the following regulations.

(1) The title of these regulations is the Plant Quarantine Title and scope.

(Harmful Organisms) (Amendment) (No. 2) Regulations, 2010 and

they shall be read and construed as one with the Plant Quarantine

(Harmful Organisms) Regulations, 2004, hereinafter referred to as

“the principal regulations”.

(2) The scope of these regulations is to transpose

Commission Directive 2010/1/EU of 8 January, 2010 amending

Directive 2000/29/EC.

In Part B of Schedule II to the principal regulations, in

point 2 of heading (b) Bacteria, for the text in the third column,

Protected zone(s), there shall be substituted the following

“E, EE, F (Corsica), IRL, I (Abruzzo, Apúlia, Basilicata,

Calabria, Campania, Emilia-Romagna (the provinces of

Parma and Piacenza); Friuli-Venezia Giulia, Lazio, Liguria,

Lombardy (except the province of Mantua), Marche, Molise,

Piedmont, Sardinia, Sicily, Tuscany, Umbria, Valle d’Aosta,

Veneto (except the provinces of Rovigo and Venice, the

communes Castelbaldo, Barbona, Boara Pisani, Masi,

Piacenza d’Adige, S. Urbano, Vescovana in the province of

Padova and the area situated to the south of highway A4 in

the province of Verona)), LV, LT, P, SI (except the regions

Gorenjska, Koroška, Maribor and Notranjska), SK (except

the communes of Blahová, Horné Mýto and Okoč (Dunajská

Streda County), Hronovce and Hronské Kľačany (Levice

County), Málinec (Poltár County), Hrhov (Rožňava County),

Veľké Ripňany (Topoľčany County), Kazimír, Luhyňa,

Malý Horeš, Svätuše and Zatín (Trebišov County)), FI, UK

(Northern Ireland, Isle of Man and Channel Islands)”.

Part B of Schedule III to the principal regulations shall be

amended as follows

(a) in point 1, for the text in the second column,

Protected zone(s), there shall be substituted the following

“E, EE, F (Corsica), IRL, I (Abruzzo, Apúlia,

Basilicata, Calabria, Campania, Emilia-Romagna (the

provinces of Parma and Piacenza); Friuli-Venezia

Giulia, Lazio, Liguria, Lombardy (except the province

of Mantua), Marche, Molise, Piedmont, Sardinia,

Sicily, Tuscany, Umbria, Valle d’Aosta, Veneto (except

the provinces of Rovigo and Venice, the communes

(b) in point 2, for the text in the second column,

Part B of Schedule IV to the principal regulations shall Amends Schedule

be amended as follows

(a) point 21 shall be amended as follows

(i) in the second column, Special requirements,

for point (c) there shall be substituted the following

“(c) the plants originate in the Canton of

Valais in Switzerland, or”;

(ii) for the text in the third column, Protected

zone(s), there shall be substituted the following

“E, EE, F (Corsica), IRL, I (Abruzzo,

Apúlia, Basilicata, Calabria, Campania, Emilia-

Romagna (the provinces of Parma and Piacenza);

Friuli-Venezia Giulia, Lazio, Liguria, Lombardy
