Dangerous Substances and Preparations (Amendment)

Regulations, 2009

IN exercise of the powers conferred by articles 38 to 40 of the

Product Safety Act, the Minister of Finance, the Economy and

Investment, on the advice of the Malta Standards Authority, has made

the following regulations:-

The title of these regulations is the Dangerous Substances Citation.

and Preparations (Amendment) Regulations, 2009, and they shall be

read and construed as one with the Dangerous Substances and S.L. 427.28

Preparations Regulations, hereinafter referred to as "the principal

regulations".

These regulations implement the provisions of Article 56 Scope.

of Regulation (EC) No 1272/2008 of the European Parliament and of

the Council of 16 December 2008 on classification, labelling and

packaging of substances and mixtures, amending and repealing

Directives 67/548/EEC and 1999/45/EC, and amending Regulation

(EC) No 1907/2006.

(1) In the first indent of regulation 6.2 of the principal Amends

regulations, for the words "Annex I to Directive 67/548/EEC" there regulation

the principal

shall be substituted the words "Part 3 of Annex VI to Regulation (EC) regulations.

December 2008 on the classification, labelling and packaging of

substances and mixtures".

(2) In regulation 6.3 of the principal regulations, for the words

"Annex I to Directive 67/548/EEC" there shall be substituted the

words "Part 3 of Annex VI to Regulation (EC) No 1272/2008 of the

European Parliament and of the Council of 16 December 2008 on the

classification, labelling and packaging of substances and mixtures".

In the first indent of regulations 13.2.3 and 13.2.4 of the Amends

principal regulations, for the words "Annex I to Directive 67/548/ regulation

the principal

EEC" there shall be substituted the words "Part 3 of Annex VI to regulations.

In points (a) and (b) and the last paragraph starting

with the words "Where they are not given" in the Second Schedule to

the principal regulations, for the words "Annex I to Directive 67/548/

EEC" there shall be substituted the words "Part 3 of Annex VI to

Regulation (EC) No 1272/2008 of the European Parliament and of the

Council of 16 December 2008 on the classification, labelling and

packaging of substances and mixtures".

(2) In the following points of Part A of the Second Schedule to

the principal regulations, for the words "Annex I to Directive 67/548/

EEC" there shall be substituted the words "Part 3 of Annex VI to

Regulation (EC) No 1272/2008 of the European Parliament and of the

Council of 16 December 2008 on the classification, labelling and

packaging of substances and mixtures"

Parliament and of the Council of 16 December 2008 on the

classification, labelling and packaging of substances and mixtures".

(1) In points (a) and (b) of the Introduction of the Third Amends the

Schedule to the principal regulations, for the words "Annex I to Third

Directive 67/548/EEC" there shall be substituted the words "Part 3 of regulations.

Annex VI to Regulation (EC) No 1272/2008 of the European

Parliament and of the Council of 16 December 2008 on the

classification, labelling and packaging of substances and mixtures".

(2) In the following points of Part A, section (a) Aquatic

environment, of the Third Schedule to the principal regulations, for

the words "Annex I to Directive 67/548/EEC" there shall be

substituted the words "Part 3 of Annex VI to Regulation (EC) No

1272/2008 of the European Parliament and of the Council of 16

December 2008 on the classification, labelling and packaging of

substances and mixtures"

1272/2008 of the European Parliament and of the Council of 16

December 2008 on the classification, labelling and packaging of

substances and mixtures".

to the principal regulations, for the words "Annex I to Directive 67/

548/EEC" there shall be substituted the words "Part 3 of Annex VI to

Regulation (EC) No 1272/2008 of the European Parliament and of the

Council of 16 December 2008 on the classification, labelling and

packaging of substances and mixtures".

(2) In point 9 of section B of the Fifth Schedule to the

principal regulations, for the words "Annex I to Directive 67/548/

EEC" there shall be substituted the words "Part 3 of Annex VI to

Regulation (EC) No 1272/2008 of the European Parliament and of the

Council of 16 December 2008 on the classification, labelling and

packaging of substances and mixtures".

In the third column of the table under point 2 of

Part A of the Sixth Schedule to the principal regulations, for the

words "Annex I to Directive 67/548/EEC" there shall be substituted

the words "Part 3 of Annex VI to Regulation (EC) No 1272/2008 of

the European Parliament and of the Council of 16 December 2008 on

the classification, labelling and packaging of substances and

mixtures".

(2) In point 1, first paragraph, and in the first column of the

table under point 3 of Part B of the Sixth Schedule to the principal

regulations, for the words "Annex I to Directive 67/548/EEC" there

shall be substituted the words by "Part 3 of Annex VI to Regulation

(EC) No 1272/2008 of the European Parliament and of the Council of

16 December 2008 on the classification, labelling and packaging of

substances and mixtures".

(3) In point 1, paragraph 3, first indent and paragraph 5 of Part

B of the Sixth Schedule to the principal regulations, for the words

"Annex I" there shall be substituted the words "Part 3 of Annex VI to

Regulation (EC) No 1272/2008 of the European Parliament and of the

Council of 16 December 2008 on the classification, labelling and

packaging of substances and mixtures".

(4) In point 4.2, in the final paragraph of Part B of the Sixth

Schedule to the principal regulations, for the words "Annex I to

Directive 67/548/EEC (19th adaptation)" there shall be substituted

the words "Part 3 of Annex VI to Regulation (EC) No 1272/2008 of

the European Parliament and of the Council of 16 December 2008 on

the classification, labelling and packaging of substances and

mixtures".
