Trusts Act (Amendment of article 43(7)) Regulations, 2008

IN exercise of the powers conferred by articles 43(7) and 49(1)(c)

of the Trusts Act as retained in force by article 35(3) of the Trusts

(Amendment) Act, 2004 and by article 57(1)(c) of the Trusts and

Trustees Act, the Minister of Finance, the Economy and Investment,

after consultation with the Malta Financial Services Authority, has made

the following regulations>

(1) The title of these regulations is the Trusts Act Citation and

commencement.

(Amendment of article 43 (7) ) Regulations, 2008.

(2) These regulations shall come into force on the 1 st

December, 2009 and shall apply to fees falling due on or after the said

date. Nothing in these regulations shall be deemed to affect the liability

in respect of any fees due under the Trusts Act prior to the coming into

force of these regulations.

“the Act” means the Trusts Act<

“the Authority” means the Malta Financial Services Authority.

(2) Words and expressions which are also used in the Act

shall have the same meaning as in the Act.

In article 43 (7) of the Act, for the words “on the payment of Amends

(7) of the Act.

a fee of Lm15”, there shall be substituted the words “on the payment of

a fee of €34.94 until 30 th November 2009 and on the payment of a fee

of €120 as from the 1 st December, 2009”
