PRODUCT SAFETY ACT

(CAP. 427)

The Community Energy-Efficiency Labelling Programme for

Office Equipment (Implementation) Regulations, 2008

IN exercise of the powers conferred by articles 38 to 40 of the

Product Safety Act, the Minister of Finance, the Economy and

Investment, acting on the advice of the Malta Standards Authority, has

made the following regulations>–

(1) The title of these regulations is the Community Energy- Citation and scope.

Efficiency Labelling Programme for Office Equipment

(Implementation) Regulations, 2008.

(2) These regulations apply to the requirements of

Regulation (EC) No 106#2008 of the European Parliament and of the

Council of 15 January 2008 on a Community energy-efficiency labelling

programme for office equipment as regards the use of the Common

Logo, and the placing on the market of office equipment bearing the

Common Logo.

(1) The Director of Regulatory Affairs in the Malta Standards National

Authority, or his designate, as referred to in the Establishment of representative.

Directorates of the Malta Standards Authority Order, 2008, shall assume L.N. 39 of 2008.

the functions of the national representative within the meaning of Articles

8 and 9 of Regulation (EC) No. 106#2008.

(2) The Director of Market Surveillance in the Malta

Standards Authority, or his designate, as referred to in the Establishment

of Directorates of the Malta Standards Authority Order, 2008, shall

assume the functions and responsibilities of market surveillance and

control of abuse with in the meaning of Regulation (EC) No. 106#2008.

The provisions of articles 6, 12, 14, 23, 26, 29, and 32 of the Contraventions.

Product Safety Act shall apply in respect of offences under Article 12,

paragraphs 1 and 2, of Regulation (EC) No. 106#2008.
