MALTA RESOURCES AUTHORITY ACT
(CAP. 423)
Cogeneration (Amendment) Regulations, 2008
IN exercise of the powers conferred by sub-article (1) of article
28 of the Malta Resources Authority Act, the Minister for Resources
and Rural Affairs, after consultation with the Malta Resources
Authority, has made the following regulations:-
(1) The title of these regulations is the Cogeneration Title, Scope and
Commencement.
(Amendment) Regulations, 2008 and they shall be read and construed
as one with the Cogeneration Regulations, 2007, hereinafter referred L.N. 2 of 2007.
to as “the principal regulations”.
(2) These regulations give effect to Commission Decision
2007/74/EC of the 21 st December 2006 establishing harmonised
efficiency reference values for separate production of electricity and
heat in application of Directive 2004/8/EC of the European
Parliament and of the Council.
(3) These regulations shall come into force on the 22nd
August, 2008.
Regulation 12 (1)
Harmonised efficiency reference values for separate production of
heat
In the table below, the harmonised efficiency reference values for
separate production of heat are based on net calorific value and
standard ISO conditions (15ºC ambient temperature, 1.013 bar,
60% relative humidity).

temperature is of 250°C or more.

regulations.
(a)
in sub-regulation (1) thereof:-
(i) the words “established by the Commission in
accordance with the Directive” shall be substituted by the
words “established by regulations 12 and 13 hereof”; and
(ii) the words “,within six months after the adoption
of these values,” shall be deleted; and
(b) in sub-regulation (4) (c) thereof, the words “by the
Authority” shall be substituted by the words “by these
regulations”.
Regulation 12 (2) (4)
Correction factors relating to the average climatic situation and
method for establishing climate zones for the application of the
harmonised efficiency reference values for separate production of
electricity
Correction factors relating to the average climatic situation
Ambient temperature correction is based on the difference between
the annual average temperature and standard ISO conditions
(15ºC). The correction will be as follows
•
0.1 % - point efficiency loss for every degree above 15ºC;
•
0.1 % - point efficiency gain for every degree above 15ºC;
Example
When the average annual temperature is 10ºC, the reference value
of a cogeneration unit has to be increased with 0.5%-points.
Immediately after regulation 11 of the principal regulations, Adds new
regulations 12 and
there shall be added the following new regulations:-
13 to the principal
regulations.
Establishment
“12. (1) The harmonised efficiency reference
values for separate production of electricity and heat shall
be as set out in Schedule 5 and Schedule 6 respectively.
(2) The correction factors set out in Schedule
7 shall be applied in order to adapt the harmonised
efficiency reference values set out in Schedule 5 to the
average climatic situation. The correction factors for the
average climatic situation shall not apply to fuel cell-based
cogeneration technology.
(3) The correction factors set out in Schedule
8 shall be applied in order to adapt the harmonised
efficiency reference values set out in Schedule 5 to avoid
grid losses. The correction factors for avoided grid losses
shall not apply to wood fuels and biogas.
(4) Where both the correction factors set out in
Schedule 7 and those set out in Schedule 8 apply, those set
out in Schedule 7 shall apply before those set out in
Schedule 8.

Example
A 100kW cogeneration unit with a reciprocating engine driven
with natural gas generates electricity of 380V.
Of this, 85%
electricity is used for own consumption and 15% is fed into the
grid. The plant was constructed in 1999. The annual ambient
temperature is 15ºC (so no climatic correction is necessary).
In terms of Schedule 5 of these regulations the harmonised
efficiency reference value of 1999 for natural gas is 51.1%.After
the grid loss correction the resulting efficiency reference value for
the separate production of electricity in this cogeneration unit
would be based on the weighted mean of the factors in this
Schedule
Ref Eη = 51.1 % * (0.860 * 85 % +0.925 * 15 %) = 44.4 %”

(1) The harmonised efficiency reference values
set out in Schedule 5 shall apply in relation to the year of
construction of a cogeneration unit. These harmonised
efficiency reference values shall apply for 10 years from
the year of construction of a cogeneration unit, which for
the purpose of this regulation shall be considered to be the
calendar year of the first electricity production.
(2) From the eleventh year following the year of
construction of a cogeneration unit, the harmonised
efficiency reference values set out in Schedule 5, shall
relate to a cogeneration unit of 10 years of age. These
harmonised efficiency reference values shall apply for one
year.”.

regulations there shall be added the following new schedules
