Equal Treatment of Persons (Amendment) Order, 2007

IN exercise of the powers conferred by sub-article (2) of article

4 of the European Union Act, the Prime Minister has made the

following Order:-

The title of this Order is the Equal Treatment of Persons Title.

(Amendment) Order, 2007, and it shall be read and construed as one

with the Equal Treatment of Persons Order, 2007, (L.N. 85 of 2007.) L.N. 85 of 2007

hereinafter referred to as “the principal Order”.

In sub-article (3) of article 2 of the principal Order

Amends article

2 of the principal

Order.

(a) for the words “a genuine occupational requirement”

there shall be substituted the words “a genuine and determining

occupational requirement”; and

(b) in the proviso thereto, for the words “a genuine

occupational requirement” there shall be substituted the words

“a genuine and determining occupational requirement”.

Article 10 of the principal Order shall be amended as Amends article

10 of the principal

follows

Order.

(a) immediately after sub-article (1) thereof there shall

be inserted the following new sub-article

“(2) The Commissioner may also conduct

independent surveys, publish independent reports and make

recommendations on any issue relating to discrimination.”;

and

(b) sub-article (2) thereof shall be renumbered as sub-

article (3).

In article 11 of the principal Order, immediately after sub-

“(4) The Commissioner may also provide independent

assistance to victims of discrimination to enable them to pursue

their complaints.”.
