Housing Authority (Transfer of Assets) (No. 5) Order, 2006

IN exercise of the powers conferred by article 12 of the Housing

Authority Act, the President of Malta has made the following order>-

The title of this order is the Housing Authority (Transfer of

Assets) (No. 5) Order, 2006.

The property described in article 4 of this order is hereby

specified for the purpose of article 12 of the Housing Authority Act.

The property specified in article 2 of this order shall be

transferred and vest in the Housing Authority as provided in the article

aforesaid with effect from the 26th September, 2006.

The property referred to in article 2 of this order is the

following, that is to say>

(1) A block of building consisting of 54 maisonettes and

66 underlying garages at Triq Salvatore Castaldi, Trejqet il-Beatu

Dun :or; Preca, Trejqet Giacchino Le Brun and Triq il-Kurunell

Cocks, in Pembroke.

Maisonettes 1 to 3, 53 and 54 are accessible separately from

Triq Salvatore Castaldi, 4 to 22 are accessible separately from Triq

il-Kurunell Cocks, 23 to 28 are accessible separately from Trejqet

Giacchino Le Brun and maisonettes 29 to 52 are accessible

separately from Trejqet il-Beatu Dun :or; Preca.

Garages 1 to 66 underlie the above maisonettes and are

accessible from common entrances in Triq Salvatore Castaldi,

Trejqet il-Beatu Dun :or; Preca and Trejqet Giacchino Le Brun.

The whole building block has been erected on Government

land which is ex-Services property and is bounded on the North-

East by Triq Salvatore Castaldi, on the South-West by Trejqet

Giacchino Le Brun and on the South-East by Triq il-Kurunell

Cocks.

The plot relative to the building block is shown edged red on

P.D. 2006_488. (HAM 4#98 vol. 4).

(2) A house, numbered 40, and a underlying garage, with

separate entrance, in Triq San wann, Bir]ebbu;a. The site including

both house and garage is bounded on the South-East by property

transferred to the Housing Authority, on the West by Triq San

wann and on the North by provate property. The relative plot is

shown edged red on P.D. 292_90_2. (HAM 47#98).

(3) Residential premises numbered 25, formerly 66, Triq

in-Narçis, Santa Lucia, registered in the Government Property

Division as Tenement No. 64897 and bounded on all sides by

property belonging to the Government, granted on temporary

emphyteusis to Joseph and Teresa Polidano as per contract dated

14th January, 1967 in the records of Notary A. Grech, as appearing

on L.D. 11#82#72. (HAP 3#2006).

(4) Plot numbered 45, in Triq i]-}ernieq, St Paul’ s Bay,

registered in the Government Property Division as Tenement No.

41564 and bounded on all sides by property belonging to the

Government, granted on perpetual emphyteusis to Spiridione

Falzon as per contract dated 6th October, 1976 in the records of

Notary A. Grech, as appearing marked P.45 on L.D. 84#87#3. (HAP

5#2006).

(5) A block consisting of 20 maisonettes, 43 underlying

garages and one shop at Blata l-G[olja, Mosta.

Maisonettes numbered 1 to 6 are accessible separately from

Triq Gio Maria Camilleri, maisonettes numbered 7 to 10 are

accessible separately from Triq tal-Blata l-G[olja, and maisonettes

numbered 11 to 20 are accessible separately from Triq ir-Rifu;jati

tal-Gwerra.

The garages, underlying said maisonettes, are accessible as

follows>

(a) garages numbered 3 to 12 and 38 to 45 having a

common entrance in Triq ir-Rifu;jati tal-Gwerra<

(b) garages numbered 34 to 37 having a separate

entrance in Triq ir-Rifu;jati tal-Gwerra<

(c) garages numbered 13 to 20 having a common

entrance in Triq Gio Maria Camilleri<

(d) garages numbered 21 to 24 and 25 to 32 having a

common entrance in Triq Tal-Blata l-G[olja< and

(e) garage numbered 33 having a separate entrance in

Triq Tal-Blata l-G[olja.

Shop 1 also underlies said maisonettes, having a separate

entrance in Triq ir-Rifu;jati tal-Gwerra.

The whole building block has been erected on Government

land acquired in terms of Government Notice 429 of the 10th July,

1985, and is bounded on the North-East by Triq ir-Rifu;jati tal-

Gwerra, on the South-West by Triq Gio Maria Camilleri, and on

the South-East by Triq Tal-Blata l-G[olja.

The plot relative to the building block is shown edged red on

P.D. 168_89_6_A. (HAM 8#2000 vol. 3).

(6) A group of seven blocks consisting of 92 garages and a

substation, and 12 blocks consisting of 69 flats, in Triq Pietru

D’Armeni, Triq Pietro Rossell and Triq il-Profs. Walter Ganado,

Pembroke.

The block of flats are numbered Block B1 to B14 and are all

accessible from Triq Pietro Rossell, except for Blocks B3 and B4

which are accessible from Triq il-Profs. Walter Ganado.

Block B1 consists of three flats, numbered 1 to 3, being all

accessible from a common entrance bearing Block B1. Blocks B2

to B6, B8 to B9 and B11 to B14 each consist of six flats, numbered

1 to 6, being all accessible from a common entrance bearing their

respective block number. (The flats numbered 1 to 6 in Blocks B7

and B10 are not being transferred.)

The block of garages underlie the above flats, except Blocks

B1 and B2. The 46 garages, underlying Blocks B3 to B8, are

numbered 1 to 46 and are accessible from two common entrances

in Triq Pietru D’Armeni.

Eight garages, numbered 1 to 8, underlie Blocks B9 and B11

to B14 and are accessible from a common entrance in Triq Pietru

D’Armeni. Six garages, numbered 1 to 6, and a substation underlie

Block B10 and are all accessible from a common entrance in Triq

Pietru D’Armeni.

The blocks were erected on Government Property, part of ES

16485, and are bounded on the North-West, South-East and South-

West by public roads. The transferred area is shown edged red on

P.D. 2005_404_A. (HAM 3#98 vol. 9).

(7) Residential premises numbered 139, “Cattleya”, Triq

is-Sardinell, San wann, registered in the Government Property

Division as Tenement No. 66183 and bounded on all sides by

property belonging to the Government, granted on temporary

emphyteusis to Nicholas Falzon with regard to P. 139 as per

contract dated 29th May, 1971 in the records of Notary A. Grech,

and with regard to plot “A” as per Deed 225 dated 14th September,

1988 in the records of Notary V. Miceli, both as appearing marked

red on L.D. 128#80#25. (HAP 9#2006).

(8) A block consisting of eight apartments and two garages

in Triq il-Kapuççini, Floriana. The apartments are numbered 1 to

8 and are all accessible from a common entrance bearing number

56 in Triq il-Kapuççini. The garages underlie the said apartments

and are numbered 1 and 2 and have separate entrances respectively

bearing numbers 58 and 54 in said Triq il-Kapuççini.

The block is bounded on the North-West by Triq il-Kapuççini,

and on the South-East and on the South-West by private property,

and is shown edged red on P.D. 2006_498. (HAM 11#97 vol. 3).
