PLANT QUARANTINE ACT, 2001

(ACT NO. XVIII OF 2001)

Plant Quarantine (Harmful Organisms) (Amendment) (No. 5)

Regulations, 2005

IN exercise of the powers conferred by article 32 of the Plant

Quarantine Act, the Minister for Rural Affairs and the Environment

has made the following regulations>

(1) The title of these regulations is Plant Quarantine (Harmful Title and scope.

Organisms) (Amendment) (No. 5) Regulations, 2005, and they shall be

read and construed as one with the Plant Quarantine (Harmful

Organisms) Regulations, 2004, hereinafter referred to as “the principal L.N. 97 of 2004.

regulations”.

(2) The scope of these rules is to implement the rules found

under European Union Council Directive 2005#18#EC amending

Directive 2001#32#EC as regards certain protected zones exposed to

particular plant health risks in the Community, which has been

transposed as the Plant Quarantine (Harmful Organisms) Regulations,

2004.

Schedule VII to the principal regulations shall be amended as Amendment to

Schedule VII to the

follows>–

principal

regulations.

(a)

under heading 2, paragraph (a)>

(i) in point 4, for the words from “Greece” to “Fossse

Way Roman Road)” there shall be substituted the following>

“Greece, Ireland, United Kingdom (Northern

Ireland, Isle of Man and Jersey)”< and

(ii) in point 13, the words “Blekroge, Gotlands” in the

right hand column are replaced by “Blekinge, Gotland”<

(b) under heading 2 paragraph (b), in point 2, immediately

after the word “Spain”, there shall be added the words “Estonia”

(until the 31st March, 2007)”<

(c) under heading 2 paragraph (c), points 1, 2 and 3 shall be

renumbered as points 2, 3 and 4 thereof, and immediately before

point 2 as renumbered there shall be added the following new point>

“01. Cryphonectria parasitica Czech Republic, Denmark,

(Murrill) Barr

Greece (Crete and Lesvos),

Ireland, Sweden and the United

Kingdom (except Isle of Man)”<

and

(d) under heading 2 paragraph (d)>

(i) in point 1, “Denmark” shall be deleted<

(ii) in point 3, “Italy” shall be deleted.
