European Passport Rights for Investment Firms (Amendment)

Regulations, 2004

IN exercise of the powers conferred by article 12 of the Investment

Services Act, the Prime Minister and Minister of Finance, acting on the

advice of the Malta Financial Services Authority, has made the following

regulations>-

(1) These regulations may be cited as the European Passport

Rights for Investment Firms (Amendment) Regulations, 2004 and they

shall be read and construed as one with the European Passport Rights

for Investment Firms Regulations, 2004, hereinafter referred to as “the

principal regulations”.

(2) These regulations shall be deemed to have come in force

on the 1 st May, 2004.

In regulation 6 of the principal regulations, for the words “with

any applicable laws and Guidelines.”, there shall be substituted the words

“with any applicable laws and Guidelines and the provisions of article

11(1)(b) of the Act shall not apply to a European investment firm

advertising its services in Malta.”.
