Mutual Recognition of Qualifications of Perit (Amendment)

Regulations, 2004

IN exercise of the powers conferred by article 20 of the Periti

Act, the Minister for Resources and Infrastructure has made the

following regulations> -

(l) The title of these regulations is the Mutual Recognition

of Qualifications of Perit (Amendment) Regulations, 2004, and they

shall be read and construed as one with the Mutual Recognition of

Qualifications of Perit Regulations, 2002, hereinafter referred to as

“the principal regulations”.

(2) These regulations and the principal regulations shall

come into force on the 30th April, 2004.

For regulation 9 of the principal regulations there shall be

substituted the following>

(1) The Board shall recognize the diplomas,

certificates and other evidence of formal qualifications awarded

by other Member States to citizens of Member States and as

compiled by the Minister in the schedules to these regulations,

even where those qualifications do not fulfill the minimum

requirements laid down in regulations 3 to 8 of these regulations,

by giving them as regards the taking up and pursuit of the

activities in the field of architecture and civil engineering but

subject to compliance with regulation 10 hereof, the same effect

in Malta as the diplomas, certificates and other evidence of

formal qualifications referred to in sub paragraph (i) of

paragraph (d) of sub-article (2) of article 3 of the Periti Act.

(2) The formal qualifications of architects benefiting

from the established rights pursuant to Articles 5, 11, 12 and

14 of Directive 85#384#EEC, Article 1 of Directive 85#614#EEC

and Article 1 of Directive 86#17#EEC, shall be those listed in

the First Schedule to these regulations.

(3) The formal qualifications of architects

recognized pursuant to Article 7 (2) of Directive 85#384#EEC,

shall be those listed in the Second Schedule to these regulations.

( 1) The Board shall recognise those diplomas,

certificates and other evidence of formal qualifications in the

field of architecture in the case of nationals of the Member States

whose diplomas, certificates and other evidence of formal

qualifications in the field of architecture were awarded by, or

whose training started in, the former Czechoslovakia< the former

Soviet Union or Yugoslavia and this only as per the requisites

of subarticle (2) hereof.

(2) Sub-regulation (1) hereof applies only to the

following countries and on condition that they attest that those

qualifications have, on their territory, the same effect as the

national qualifications in architecture listed in Article 11 of

Directive 85#384#EEC, which national qualifications are subject

to compliance with Articles 1 and 23 of the same Directive>-

(a) the authorities of the Czech Republic in the case

of education or training in the former Czechoslovakia

before 1 January 1993<

(b) the authorities of Estonia in the case of education

or training in the former Soviet Union before 20 August

1991<

(c) the authorities of Latvia in the case of education

or training in the former Soviet Union before 21st August

1991<

(d) the authorities of Lithuania in the case of

education or training in the former Soviet Union before 11

March 1990<

(e) the authorities of Slovakia in the case of

education or training in the former Czechoslovakia before

1 January 1993<

(f) and the authorities of Slovenia in the case of

education or training in Yugoslavia before 25 June 1991.

(3) In terms of sub-regulation (1) hereof the Board

shall only recognize the education or training acquired on the

dates given in sub-regulation (2) hereof.

(4) The attestation in sub-regulation (2) hereof shall

be accompanied by a certificate issued by the same authorities

therein indicated stating that those Member State nationals have

effectively and lawfully been engaged in activities in the field

of architecture in the authorities’ territory for at least three

consecutive years during the five years prior to the date of issue

of the certificate.

3. Immediately at the end of the principal regulations, there
