Qualifying Companies (Export Services)
(Amendment) Regulations, 1998
IN exercise of the powers conferred by sections 3(1)(e) and 44 of
the Industrial Development Act, the Minister for Economic Affairs and
Industry and the Malta Development Corporation have made the
following rules:-
(1) These regulations may be cited as the Qualifying Citation anJ
Companies (Export Services) (Amendment) Regulations, 1998, and shall commencement.
be read and construed as one with the Qualifying Companies (Export L.N. 38 of 1994
Services) Regulations, 1994, hereinafter referrred to as "the principal
regulations" .
(2) These regulations shall be deemed to have come into
force on the 1st October, 1997.

3 of the principal
Regulation 3 of the principal regulations shall be .amended as
regulations.
follows:-
(a) the whole regulation shall be renumbered as paragraph
(1) thereof;
(b) subparagraph (j) thereof shall be substituted with the
following new subparagraph
"(j) the provision from an establishment in Malta of
accountancy, control, administration and management
services to persons not resident in Malta which carry on or
carry out a trade or business consisting mainly of the operation
of hotels or catering establishments situated outside Malta;";
and
(c) immediately after paragraph (I) thereof as renumbered,
there shall be added the following new paragraph:-
"(2) For the purposes of paragraph (1) of this
regulation, the rendering of any of the above services to a
company which satisfies the provisions of paragraph (b) of
subsection (I) of section 4 of the Act, shall be deemed to be
the rendering of a service to a person not resident in Malta."
In paragraph (a) of regulation 5 of the principal regulations,
immediately after the words "except in so far as provided in the proviso
to paragraph (b) hereunder" there shall be added the words "and in the
proviso to regulation 3 hereabove".
