Swimming ('ools (Testing of Water) (Fees) Reg ulations, 1997

IN exercise of the powers conferred by sectio n 2 of the Fees

Ordinance. tlK: Min iste r of Health . Care of the Elderly and Family

Affairs. wi th the concurrence of the Min ister of Finance and Commerce,

has made the following regulations:-

In these regulations, unless the context otherwise requires -

"Superintendent'" means tlK: Superintendent of Public Health

"swimming pool"' includes any s ..... imming pool. hydrotherapy

baths. spa or OI:her anificial enclosure containing a large enough

volume of wate r that is being used or is intended to be used for

bathing purposes. whether recreational, medical or otherwise.

(a) The owner and the manager of any public or commercial Lia:oce roo ..... or

establishme nt shall not pennit the use of any swimming pool in in " public

hi s establishment without having previously obtai ned a licence "",,"i.hme"'.

(b) (i) The licence shall be rene ..... ed by the Superintendent

after the lapse of twel ve mon ths from the date of issuc.

(ii) The said licence shall be issued or renewed on a

payment of a fee of Lm50 on its issue, and Lm 2S on its

renewal. to the Superintendent.

(iii) Such licence shall not bar any othc r public

corporation or gove rnmcnt depanment from requesting the

iss ue of any othe r li cence.

(c) The Superintendent may refuse to grant or renew. or

may withdraw .any such liccnce whenever. in his opinion. the water

Contained in the swimming pool may be injurious to public health.

4 . (a) The owner of the establishment shall make gOOd allY

ex penses inc urred by the Superint end ent to carry out all the

necessary extraord inary tes tS by any person authorised todoso by

him ill order to establ is h the quality of the water in the swimmin g

pool.

(b) Such tests are to be ca rried o ut wheneve r deemed

necessary by the Superintendent.
