IN exercise of the: powers conferred by sec1ion 17 of the: Traffic

Regulatio n Ordinance and by section 27 of the Pu blic Transpon

Authority Act , the Chaimlan of the Public Transpon Authority, with

the conse nt of th e Minister for Transpon and Ports. has made the

following re gu lat ions: -

I . ( I) These regu lations may be cited as the Public Transpon

(Scheduled. Tourist. Minibus and Unscheduled Transpon Services)

(Amendmc:nt) Regu lillions, 1997 and shall be read and construed as

one with the Public Transpon (Sched uled , Tourist , Minibus and

Unschedu led Transpon Services) (Amendment) Regulations, 199 1.

hereinafter referred to as "the principal reguJations~ .

Regulati on 3 of the principal regu lations shall be amended as

follows: -

in paragraph (I) thereof:-

(a)

(i) in subparagraph (b) thereof. for the words "in

addition to the duties contemplated in regu lation T' there shal l

be substi tuted the words "subject to the provis ions of

regulation 5~: and

(ii) in subparagraph (c) thereof, for the words "to the

provisions of regulation 7"there shall be substituted the words

"to the provisions of regulation 6": and

(b) for paragraph (6) thereof. there shall be substituted the

following

"(6) NotWithstanding any provision of these regu lations,

no licensee of any motor omn ibus authorised to operate any

sc heduled transpon service may ope rate any scheduled,

unscheduled or tOUti5t service, even if licensed to opeT1lte stICh

se rvice. exce pt through the Central Office for Scheduled Bus

Services, wi th which suc h lice nsee is registered as a member."·

(I) Subject to the provisions of paragraph (6) o f

regulation 3 of the principal re'gulations,any pen;on reqllCSiing

the se rvi ces of a mOlor omnibus for th e performance of

unsched uled or touri st transport scrvices, may put suc h a

request directly through the licensed operator of such motor

omnibus, provided that such omnibus is licensed to operale

the said IOUrist orunscbeduled service,as the case may be. in

terms of the Police Licences Regulations, 1949.

(2) In the case of a licensed operator as referred

to in the immediately preceding paragraph. who is unable to

perfonn a service which has been requested directly by any

person requiri ng such service. either for tourist or unscheduled

tran sport, such operator may hire or engage suc h motor

omnibus service only from the Central Office for Unschedu led

Bus Servkes for the pe rfonnance of such service.

(3) It shall be the duty of the Central OfrlCe for

Unscheduled Bus Services to allocate tourist transport services

on a rosier system only among such category of motor

omnibuses which are registered with the said Central Office

and which are licensed to be used on tourist transport services

in tenns of the Police Licences Regulations. 1949. so as 10

ensure a fai r distribution of the gross takings derived therefrom

among such category of motor om nibuses.

(4) In the event that th e moto r o mnibuses

regi stered with the Central Office for Unscheduled Bus

Services and which are licensed to operate a tou rist or

unscheduled transport service shall not be sufficient in number

to serve all touriSt ortransport services which may be required

as the case may be,on a particular day. the Central Office for

Unsc heduled Bus Services may hire or engage such motor

omnibus se rvice only from such lice nsed operators as are

mentioned in paragraph (I) of this regulation and. in the even t

thai 5uch lice nsed operators are unable or fail 10 accepl to

perform such service. the said Central Office referred to above

may hire or engage. through the other Central Offices, the

service of a motor omnibus or motor minibus which are

licensed to perform tourist or unscheduled transport servK:es.

as the case may be and in tenns of the Police Licences

Regulations. 1949.

(5) In (he cases mentioned in paragraphs (2) and

(4) of thi s regulation, any payment due in respect of such

services. eit her for tourist or unscheduled transpon , shall be

paid by the person requiring such service directly to the

licensed operator in the fiT'lit case and to the Central Office

for Unscheduled Bus Services in the laller case ....

4 . In paragraph ( I) of regu lation 7 of the principal re gulutions,

for the words " '0 the provisions of regu lation 6( I)" there shall be

substilUted the words ··' 0 the provisions of regulations 5 (1) and 6 ( I)",

S. In paragraph (I) of regu lation 8 of the principal regulations,

for the words "among the various licensees" there shall be substituted

the words "among such licensees who are registered as members of

the said Office,".
