following regulations:-

T hese regulations may be ciled as Ihe Public Transport 0",,,"

(Scheduled and Unsc heduled Tra nsport Services) Reg ul atio ns. 1997.

2 . In ,'h ese re gu lat ions. unless the conte xt other w ise ,---'""

requires -

"motor coach" means any motor vehicle wh ich is licensed

and/or registered 10 carry more than thirty persons. excl uding

Ihe driver;

"motor route bus~ means any motor vehicle which is

licensed and/or registered to carry more than founeen persons,

excludi ng the driver

"motor minibus" means any mo tor vehic le wh ic h is

license d and/or registered 10 carry from ten to fou n ee n persons,

exc luding the dri ver, used for the con veyance of passengers

"parastatal body" means any body established by any law

and includes a p artnership or other body in whic h the

Government o f Malt a or any such body as aforesaid have a

controlling interest or over whic h they have erfedive control.

3 . (1) There shall be constituted a Central O ffice fo r ~0If ...

duties contemplated in re gulation 4 hereunder. in chrge of the ~

d istribution and allocation of all schedu led services.

(2) TheCeml1l1 Office shall keep a rcgister of il'l members

an d motor rOUle buses and enter therein the follow in g particulars

(a) the names. add reMCS and iden tification tag nu mber

of each member and of each person in the said member ' s

employment;

(b) lhe date on which each person was en tered in the

regis ter as a membe r . and th e dale of commence ment of

emp loyment of each employee;

(c) the dale on which any person ceased 10 be a member.

and tile date of termination of employment of each e mployee;

(d) tile registra tion number, chassis number ,lIId year of

manu facture of any motor rou te bus owned by each member

(e) details of any trading licences in respect of any motor

route bus ow ned by each member.

(3) T he Public Transport Authority shall ha"e the power

to inspect the Register of Members and to control the activities or

the said Central Office.

(4) The day to day admi ni stration of the Central Office

and the rel ati ve e~pendi ture shall be at the charge of the members of

the Cen tral Office.

(5) Notwit hstand ing any provision of these regulations.

no licensee of any motor rou te bus autho rised to ope rate any

sc heduled tran sport service may operate any scheduled. unscheduled

or tourist se rv ice. e .. en if licensed 10 operate such se rvice. except

through the Central Office for Scheduled Bus Transport Services .

(I) Each licensee o r a motor route bus authorised to

operate any sc hedu led transport service shall do so in accordance

with a roster pre pared by the Central Office for Schedu led Bus

Transport Ser vices.

(2) Withou t prejudice to the provisions of regulation 146

or the Motor Veh icles Regulations. 1994. it sha ll be th e duty of the

sa id Central Office to operate (subject to the approval of Ihe Publ ic

Transport AlIIhority) the roster of the motor roUle buses performing

scheduled services on lhe various routes: the said roster is 10 be

d istributed among all members and affi xed in a conspicuous place

inside the said Office.

(J) The licensee of every motor route bus performing a

scheduled transport service shill purchase It flce value his ticket

requirements from t~ said Central Office.

(4) The said Central Office shill every fifteen dlYs

distribute among the varioos licensees the share due to them from

the sale of tickets and other income. after deducting tllerefrom the

expenses incurred in tile running of the said Centr1l1 Office and

addi ng thereto any amOtlnts in respect of Iny disciplinary penalties

levied.

The distribution referred to in paragraph (4) of this

rgulation shall be made in tile proportion of tile number of days

worked andlor the number of trips performed by each motor route

bus and of the number of seau allowed on each mOior route bus.

(6) The said Central Office may levy appropriate

disciplinary penalties. to be approved by the Public Transport

Authority for tile proper administration Ind running of the service.

The said Central Office may deduct any ,uch disciplinary penalties

from the payment due to each licensee.

(7) Where I mOior route bus. licensed to be used on In y

scheduled and unsclleduled transport service. is not required on Iny

particular day 10 perform any sclleduled service in accordance witll

a roster prcpan:d and apProved under paragraph (2) of this regulation.

the licensee of such mOlor roote bus mly CIUse. aliow or permit the

said motor route bus to operate any unsclleduled transport service.

provided that no licensee of any such motor rOtlte bus shall do 50

ea~pt through tile Central OfrlCC for Scheduled Bus T rnnsport

ServicC$ in accordance with the provisions ofregulDtion 6 hereunder.

Any person requesting a transport service for tourists or _ _

unscheduled, may PUt such. reqllCSt directly through the licensed

operator of a motor coach. I motor minibus or any other vehicle

having a licence to operate the said tourist or unscheduled service.

as the cue may be. in terms of the Police Licences Regul ations. GJ< ....

1949.

(I) Any person requiring the services of any mOior route

bus for tile performance of any unscheduled transport service. shall ;;;. •• ;;;

hire or engage such service diroxtly through Ihe Central Omce --

cons!itu!ed under regulation 3 of these regu la!ions. wi th which the

said motor route bus is reg istered.

(2) It shall be the duty of such Central Office to allocate,

among its members, on a roster system, unscheduled transport

,;crvices, so as to ensure a fair di stribution of the gross takings derived

therefrom keeping in view the focilities provided by the motor route

bus.

(3) The said Central Office shall every fifteen day s

distribute among the various licenses the share due to them out of

Ihe payments made in respect ofunsceduled transport services. after

deducting from the lotallakings the expenses incurred in the running

of the said Cemral Office in respect of the said services and adding

thereto any amoum in respect of the disciplinary penalties levied.

(4) The distribution referred to in paragraph (3) of this

regulation shall be in proportion to the service performed by each

motor route bus. including the frequency. ,;cal ing capacity and length

and duration of journeys ~rformed.

(I ) When the Direc tor of Education makes provision that

certain routes for the transport of Goyernment school children be

serviced by motor route buses. such rou les shall be allocated 10 the

Central Office for Scheduled Bus Transport Services \0 be serviced

exclusively by motor rOllte buses which on the particular day arc

nO{ detailed for work on roster by the said Central Office.

(2) The p«)\'isioQS of this regulation shall appl y, milia/is

Governmental department or parastatal body.

The Public Transport (Scheduled. Tourist, Min ibus and

Unscheduled Transport Services) Regulation s, 1991, 3re hereby

being repealed.
