Motor Vehicles (Amendment) (No.2) Regu lations. 1997

IN EXERC ISE of the powers conferr~d by section 17 of the

Traffic Re gulation Ordinance the Commissioner of Police. with the

advice of the Traffic Control Board . ha s made th e following

regu]ations: ~

hereinafter referred to as "the principal regulations".

(2) These regulations shall come into force on the 15th

January. 1998.

"67. (I) lfinanycase.owingtothepresenceofa

motor vehicle on a road. an acc ident occu rs involving

personal injury w 3Ilother person or damage to any vehicle.

animal or other propeny, the driver of Ihe motor vehicle

mUSI SlOp and, if required to do so by any person having

reasonable grounds for so requi rin g, give his name and

address. the n3/lle and address of the owner of the mowr

vehicle, the details of the insurer of the vehicle as well as

its registration mark or number.

(2) Saving the provisions of paragraph (4) of

this regulation. where any case to which paraa:raph (I) of

thi s regulation applies consists in an acc ident fitting Ihe

description in Schedule II to these regulations but nOI

involving personal injury or damage to public propeny,

each driver or owner. as the case may be, shall also give

all relevant information regarding the circumstances of the

accident on suc h appropriate fonn supplied by the driver's

orowner's respective insurer, which form sha ll be delivered

to the respective insurer by nOllater than the nellt wort ing

day following the date of the accidem. In such cases. and

following the exchange of such information as is required

hy th is regu btion, the persons invol ved in tile accident shall

wke steps to e nsure the immediate removal of anything

which may be obstructi ng the free course of traffic,

(3) The form referred to in paragrapll (2) of th is

Il'gulation shall nOi be admissible in e"idcnee in criminal

proceedings except

(a) in c riminal procecdings in respect of any

false declaF.ui, n or informatio n in tile aforcsaid form

(b) at the instance o f the accused who is the

dri"c r or ow ner who gave tl>e relevant informat ion in

the afo resaid fonn .

(4) In any case to which paragraph (2) of th is

regulation appli es , where the drivers or owners of the

"chicles agree on the facts of the acci de nt . tl>e y may give

the n:lc\'ant in fonn ation o n the circumstances of the

accident on such appropriate fonn supplied by the drivers'

or owners' ins uTers . which form shall be de li vered to their

respective insurers by not later than the ne ~t worldng day

provis ions of paragraph (2) of thi s regulation Shall appl y.

(5) In any case to which paragraph ( 1) of th is

regulat io n applies. nO! bl:ing a case to which paragraph

(2) of this re gula tion ap pli es. th e dri ve r shall al so

immediately no ti fy th e Police who s hall take th e

appropriate ste ps.".

J . In paragraph (2) o f reg ulat io n 21 1 of the prin ci pal

regulations for the "'oros "i n t be Schedule" there shall be substituted

"in Sel>edule I".

4 . The presen t schedu lc to the principal regulations shall be

renumbered "Sc1lcdule r' and immediately thereafte r there shall be
