IN exercise of the power conferred by sections 27 and 45 of Ihe

Water Services Corpornlion Aa, 1991 ,the Water Services Corporation,

with the approval of the Minister of Public Works and Construction ,

has made the following reg ulations:-

In these regulations, unless the context otherwise t_p ....

reqUlres:-

"Act" meM5 the Water Services Corporation Act, 1991;

"Corporation" means the Water Services Corporation as

established by the Act;

"officer" includes My person engaged by,detailed for duty

with, or in any manner whatsoever performing duties for or on

behalf of tile Corporation ;

"user" means the person who. solely or jointly wilh olhers.

has the effective control of use of one or more water tan kers;

"water" includes brackish water, domestic sewage , sea

water, stormwater run-off, trade effluent. underground water. and

wholesome water, but it does not include bottled table-water;

"water tanker" means any vehicle which is used for trans-

poning a volume of water of nO( less than three cubic meters.

(2) The meanings set out in the Act shall De applicable in these

regulations, unless the context requires otherwise.

( I) Every user shall . within twenty-one days of the coming Roportiqof_

into force of these regulations, inform the Corporation of the existence -

of all water tankers, whether or not so registered with the Corporation

and/or the Police, over which he has effective control of use.

(2) The information required in paragraph ( I) of this regu-

lation shall be given on the fonn shown in the schedule to these regu-

lations . and shall include all the particulars and shall meel all the re-

quirements slipulated therein.

(3) The fonn indicated in paragraph (2) o f this regu lation

may be collected from the offices orlne Corporaiioo or from an y other

place which the Corporation may designale.

4 . (I) T here s hall be paid to the Corporalion, upo n the

regislrallon ofa water tanker ,an administration charge of thirty mallese

liri.

(2) A water tanker shall nO! be deemed to be registered

for the purposes of these regu lations unless and until the relative ad-

ministration charge has been paid.

(3) If a water lanker is registered by more than one per-

son, only one administmtion charge shall be paid with regard to such

water tanker.

SUbject 10 the provisions of these regUlations, every water

lanker registered in accordance wilh the provisions of regul3lions 3

and 4 of Ihese regulations shall be deemed to be operating under a

temporary pennit from the Corporation .

( I) Every use r who fails to infonn the Corporation as

prescribed in regulations 3 and 4 of Ihese regulations. or who submits

incorrect, incomplete or false information, shall be gui hy of an offence

and shall be liable to It fine (multa)ofnot less than four thousand maltese

liri (Lm4.ooo) but 001 exceeding eight thousand maltese liri (LmS.ooo)

and to the confiscation of the vehicle and other equipment used to

transport water.

(2) Such fine shall be payable within a period of time as

the Coun in pass ing sen tence shall direct.

(3) Such fine and confiscation shall be without prejudice

to any other punishmenl for which lhe user woukl be liable under any

other law Of regu lation.

The Corpor:uion maydesignale any officer or officers to carry

out duties in connection with. or arising from , these regulat ions.

Notwithstanding that a water tanker has been registered and

the relative administration charge paid. the Corporation may at any

time order the use r to discontin ue tmnsponing water by means of such

water tanker. If the Corporation orders Ihe use r 10 discon tinu e

trnnsporting water by means of a water tanker ,the administf3lion charge

whi ch would have been paid in respccr of such a watcrtank er shal l nOt

be refunded.

The reg istration of a walertankeraccording to these regulations Thiod pot'Iy

shall in no way prejudice any right or claims which third parties may

have over such water tanker.

or licence whi ch may be required by any other law or regulation.
