Drilling Ri gs (Registration) Regulations, 1997

IN exercise of the power confened by S(:Clions 27 and 45 of the

Water Services Corporruion Act. 199 1. the Waler Services Corporation,

with the approval of the Minister of Public Works and Construction.

has mnde the foll owing regulations:-

"Act" means the Water Services Corporotion Act, 199 1.

"drilling ri g" or "rig" means any equipment intended for use

to drill holes of a diameter grealer than one hundred millimeters

and of a depth in excess of fifteen mete rs. It includes also any

equipment. whether registered or not with the Police as a normal

heavy vehicle or heavy plant. which is temporarily or permanently

altered mechanically so as to drill holes as menlioned above

"Corporati on" means the Water Services Corporation as

establ ished by the Act

"officer" includes any person engaged by. detailed for duty

with. or in any man ner wh::nsoever perfomling duties for or on

behalf of tlie Corporation

"use r" means the person who has the effective contro l of use

of the drilling ri g.

(2) The meanings set out in the Act shall be appl icable in

these regulalions. unless the context requires otherwise.

(2) T he information required in paragraph ( 1) of this

regulation shall be given in the form established by the Corporntion in

the Schedule to these regulations. and shall include all the particulars

and shall meet all the requirements stipulated therein.

The form indicated in paragraph (2) of this regulation

may be collected from the offices ofthc Corporation or from any other

place which the Corporation may dc.~ignate.

There shall be paid to the Corporation. upon the

registration o f the drilling rig, a fee of thirty maltese I iri.

(2) A drilling rig shall nOl be deemed [0 be registered for

the purposes of these regulUfions unless and until the re lUfive fee has

been paid.

If a drilling rig is registered by more tMn one person,

only one fcc shall be paid.

Subject to the provisions of these: regu lations, every drilling

rig registered in accordance with the provisions of regul:llions 3 and 4

of these regulations shal l be deemed to be operated under a temporary

licence from the Corporntion.

(I) Every user who fails to inform the Corporatioll as

prescribed in regu lUfions 3 and 4 of these regulations. or who submits

incorrect. incomplcte or false infonmuion. shall be guilty of an offence

and shall be liable loa fine (mulla) of nO( less than fou r thousand maltese

liri (Lm4JXXl) but nO( exceeding eight thousand maltese liri (Lm8,OOO)

and to the confi scation o f the dri11ing rig.

(1) Such fine shull be payable within a period of time as the

Cou rt in passing semcnce shall direct.

(3) Such fine and confiscation shall be O\'er and above. and

in addition to. any other punishment for which he would be liable under

any other law or regulation.

The Corpor:llion may designate any officer or officers to carry

ou t duties in conneCfion with. or arisi ng from. these regu lations.
