Airport (Passenge r Service Charge) Regulations, 1997

IN exercise of the powers conferred by sectio n 3 of the Civi l

Aviation Act , the Mini ster for Transport an d Ports, wi th the

concurrence of the Minister of Fi nance and Commerce. has made

the following regulations:-

(2) These regulations shall be deemed to have come

into force o n the I St Febru ary, 1997.

I n these regulations. unless the context otherwise IMtflIfWIIioft.

requires -

"depa rt ing passe nger" means a passenger who

commences a voyage by air fro m Malta for a destination

outside Malta , other than in a military airc raft. and who does

not return to Malta on the same day of departure;

" Director" means the Director of Civil Aviation and

includes any publie officer in his department so de legated

by him for the purpose of these regulations;

" posi tioning air c rew" means membe rs of the nying

staff of an ai rcraft o pe rating company tra vell ing on duty as

passengers on a flight to a place from which they will operate

in an aircraft as me mbers of the crew the reof. provided thei r

ticke t or other travelling document is endorsed by the airc raft

operator to that effect.

3, For the services and fac ilities provided for a d e p~rting

passenger from the Malta International Airp0rl , there shall be

payable to the Direc to r by t he ai rc raft owner or the airc raft

operator, as the case ma y be, a fee of Lm4 in respect of each

departing passenger embarking o n hi s aircraft.

These regul ations shall not apply 10 posilion ing air crew

or in fants unde r two years of age.
