Telephone Ser vice (Amendment) Regula tions, 1996

IN exercise of the powers conferred by section 37 of the Telemalta

Corporation Act. the Board. wi th the approval of the Minister for

Transport, Communications and Technology and with the concurrence

o f the Minister of Finance, has made the following regu lations:-

I , (I ) These regulations may becited as the Telephone Service

(Amendment) Rcgulations. 1996, and shall be read and construed a~

one with the Tele phone Service RegUlations, 1972. hereinafter referred

to as "the principal regulat ions".

(2) These regulations shall be deemed to ha ve come into

force as follows:-

(a)

regulations 3. 5, 6. II and 15 on the 6th July. 1995;

(b)

regulation 14 on the 1st October, 1995

(c)

regulations 4. 7.9. 12 and 17 on the 1st February . 1996

(d) regu lations 8 . 10, 13 and 16 on the date of publication

of these regulations.

For the purposes of the Value Added Tax Act, 1994, the

charges specified in these regUlations shall nOl be deemed to be inclusive

of value added tllX payable under the said Act. Value added tax shall be

billed o\'er and above the said charges, as applicable.

Regulation 2 of the principal regulations shall be amended as

follows

(a) immediately afterthe definition of "cordless telephone"

there shall be insened the following new definition

" .. credit card fax/phone" means telephonic equipment

installed on an exchange line orextension which requires users

of such equipment to insen in the appropriate slot a recognised

credit card for chargi ng purposes,": and

(b)

the definition of "coin·box for indoor usc" shall be

deleted.

For regulation 21 of the principal regu lations there shall be ~"'

21 . An agreement for the provision of telephone service

shall be re lative to a minimum initial period of six months,

and shall remai n in force thereafter unlil it is terminated by

eilher party after giving the other party at least fifteen days

notice in writing by registered post

Provided that

( I) any transfer of an installation from one self-

contained premises to another shall be deemed to be, for

the purposes of these regulations, a new inslallation;

(2) where an applicant for telephone service or a

subscriber desires to be provided with a special service

or with any other costly telephone instrument,apparatus

or equipment, or with any other installation involving a

higher cost than a normal installation, theChainnan shall

have the righl to prescribe any such longer initial period

as he may deem fit. regard being had to the material

required and to the cost of the instrument, apparatus or

equipmenl and to the normal demand for same by other

applicants or subscribers

(3) the Chairman may consider any application

for the provision of telephone service for a temporary

period being a period shoner than six months, in which

case the relative agreement shall not extend beyond the

maximum durat ion of six months.".

For paragraph (2) of regulation 35 of the principal regulations , , _

"(2) A subscriber may be allowed to provide and install a

coin-box at his own care and expense on an exchange line or on an

extension under the conditions specified in sub-paragraphs (a), (b)

and (c) of paragraph (I) of this regulation, and under the following

additional conditions

(a) the coin-box equipment shall have been previously

tested and approved by the Chairman for connection to the

public telephone system in accordance with any general and

specific conditions for the installation of private equipment

laid down in these regulations andlor further established by

the Chairman

(b)

the subscriber may, under his own responsibility.

require persons making use of his installation to insen in the

coin-boX an amount equal to or exceeding the normal tariff

charged by the Chairman under these regulations and the

Overseas Telephone Service Regulations, 1957;

(c)

the subscriber shall ensure that the coin-hox

equipment allows access to all special free services offered

by the Chairman (with the exception of access to the overseas

operator service (194), which may be barred at the option of

the subscriber) and 10 all available freephone service facilities,

at no charge whatsoever to the persons making use of the

installation for such purpose;

(d) the subscriber shall at all times keep in prominent

display and attached to the coin-box a notice specifying: -

0) that the offici al rate charged by Telemalta

COf!Xlration in respect of each call is five cents perpulse,

inclusive of Value Added Tax, that the pulse frequency

may vary in consideration of the destination of the call

and the time of the day during which such call is effected ,

and that for further information the uscrofthe installation

may dial 190 and refer to the operator enquiry service

provided by Telema!ta Corporation; and

(ii) the name and address of the owner of the coin-

box and the name and address of the imponer;

(e) subject to the obtaining of all necessary permits

from the competent authorities as may be necessary, the coin-

box equipment may be housed within a private kiosk, which

kiosk shall in all cases be of a des ign clearly different from

that penaining to Telemalta kiosks, in order to be easily

distinguishable therefrom; and

(f) unless otherwise directed by the Chairman, the

private kiosk housing the coin-box equipment may be installed

in the vicinity of a Telemalta kiosk housing a public telephone

fitted with a coin-box or card phone equipment made available

by Telemalta Corporation.

(3) Nothing contained in paragraph (2) of this regulation

shall be construed as granting any permission to any person to

provide and install any coin-box, in accordance with the conditions

therein mentioned, otherwise than on an exchange line or on an

extension provided by the Chairman, Telemalta Corporation.",

(I) of regulation 35, and under the following additional

conditions

(a) the credit card fax/phone equipment shall have

been previously tested and approved by the Chairman

fo r connection to the public telephone sys tem in

accordance wi th any general and specific condit ions for

the installation of private equipment laid down in these

regulations and/or further established by the Chairman;

(b) the subsc r iber may. under hi s own

res ponsi bility . c ha rge persons making use of hi s

installation an amount equal to or exceeding the normal

tariff charged by the Chairman under tllese regulations

and the Overseas Telephone Service Regu lations. 1957;

(c) the subscribe r shall ensure tllat the credi t card

fax/phone equipment allows access to all special free

services offered by the Chairman (with the exception of

access tothe overseasoperalorservice (1 94), wh ich may

be barred at the option of the subsc riber) and to all

avai lab le freephone service faci lities. al no cha rge

whatsoever to the persons making usc of the installation

for such purpose;

(d) the su bscriber shall at all times keep in

The subscriber shall pay renuals in respect of each

installation. and of each pan thereof which i§ provided and

maintained by the OIairman. at the rate specift«l in the: Second

Schedule to these regulations and/or in any other Schedule

hereto specifying the charges for certain specifIC services and

facilities

Provided that when the installation includes any

instrument. apparatus or equipment or any other pan which

i§ not nonnally provided by the Chainnan and for which no

rentals are fixed in the Se<:ond Schedule or in any other

Schedule hereto, the Cha irman shall have the right to fix such

rentals as he will consider appropriate in each case.".

8. Immediately after paragraph (3 ) in regulution 39 of th e

principal regulations the re shall bc added the following new

paragraphs

"(4)

Where. in consideration of 1\ change in circumstaoccs,

an exchange line which is charged the residence rate of renlal

requires 10 be charged the business rate of ren tal, or vice versa, in

accordance with the above provisions. the subscri ber shall

immediately no ti fy th e Chairman and make the req uired

arrangements as may be requested.

(5) Where the installation is disconnected owing to failu re

by subscriber to abide by the prov isions of paragraph (4) of this

regul ation. reconnection shall not be made before the subscriber

makes the required arrangements as are acceptable to the Chai rman

and, moreover, pays such charge for recon neclion as is prescribed

under Pan 1II of the Sixth Schedule hereto:',

Provided that whcre the installation requires any

instruments , apparatus o r equi pmen t o r any other pan wh ic h

is not nonnally provided by the C hainnan and for whic h no

connection charges are established in the Fi rst Schedule o r in

any other Schedule hereto, or where the installation requires

any internal or external wiring or cabling of a mo re expensive

type or of a greater length than used in nonnal installations,

the Chainnan shall have the right to fix such higher charges

as he may eonsider appropriate in each ease 10 recove r any

extra cost thereby illCurred ,"

Immediately after paragraph (2) in regulation 46 of the

principal regulations there shall be added the following proviso

"Provided however that, where an existing installation consists

of an exchange line (main line) and internal extension/s, the new

subscribe r shall pay the admini strative charge specified in Part IV

of the Sixth Schedule hereto instead of the connection charges

specified in the First Sc hedule to these regulations in respect

thereof.".

II , For puragraph (2)of regu lation 47 of tile principal regulations

there shall be substituted the following

"(2) Where [he exchange linc is provided with a coin-box,

users of such li nc shall insert in the box the re lative coin or coins

in payment of each call: where the exchange line is provided with

a card phone or a credi t card fax/phone , users of such line shall

insert in the relative equipment the appropriate phonecard or credi t

card, as necessary, for charging purposes." .

12. Immediately after paragraph (5) in regulation 47A of the

principal regulations there shall be inserted the following new parogrnph

"(6) The charges applicable in respect of the provision of

telephooc service for a tem porary period not exceeding si x months

shall be those specified in th e Twe lfth Schedule to these

regul ations:'.

13. Re gulations 53, 54, 55, 56 and 57 of the principal regulations

shall be respec tively renumbered as regulations 52 , 53, 54, 55 and 56

thereof. Regulations 52A and 55A of the principal regulations shall be

respectively inserted after regulations 52 and 55,as renumbered, thereof.
