Regulations, 1996

IN exercise oftbe powers conferred by section 37 of the Telemalta

Corporation Act. the Board. with the approval of the Minister for

Transpon. Communications and Technology and with the concurrence

of the Minister of Finance, has made the following regulations:-

I . (I) These regulations may be cited as the Telephone Service

(Amendment) (No. 5) Regulations, 1996,and shall be read and construed

as one with the Telepho ne Service Regulations. 1972 , hereinafter

referred to as "the principal regulations".

(2) These regulations shall be deemed to have come into

force on the 23rd November. 1995.

For the purposes of the Value Added Tax Act . 1994. the

charges specified in these regulations shall not be deemed to be inclusive

of value added tax payable under the said Act. Value added tax shall be

bi lled over and above the said charges. as applicable.

3, Regulation 2 of the principal regulations shall be amended as

(a) immediately after the definition of "external extension"

there shall be inserted the following new defini tions

""full digital data circuit" means a point·to-point digi tal

data circuit o perating at the same speed from one end point to

the other and connecting pre mi ses , being subscribe r' s

premIses;

"half digital data circuit" means a point-to-point digital

data circuit operating at a speed of 64 Kbitls connecting a

subscriber's premises 10 Digital Data Network eq ui pment at

a Telemalta Corporation site for the purpose of multiplexing

data signals onto another point-to-point digital data circuit

operating at a speed of 2 Mbitls connecting a Telemalta

Corporation site 10 a subscriber's premises;";

(b) for the definition of "installation" the re shall be

substituted the following definition

.. "installation" means equipment or apparatus provided

by the C hainnan, Telemalt8 Corporation 10 8 subscriber as 8

means of telecommunication wholly or in part through the

medi um of the public telep ho ne system or any other

telecommunications network operated by Telemaha

Corporation, and includes any subsidiary or relative equipment

or apparalUS;"; and

(c) the defi nitions of "common equipment", "high speed

modem". "high speed NJ'U", "Iow speed channel" . "Iow speed

NTU" ," network usage", " NTU" , "subscribe r multiplexer (S-

MUX)" and "synchrono us/asynchronous converter" shall be

de leted.

3. Temporary Se.-vice Rental Charges

For the provision of a temporary service for

the duration of less tha n one month there shall be

paid a fixed rental charge of Lm200 per circuit

provided. For temporary services of the duration

of one month or more, the stipulated annual rental

c harges shaH be applicable pro rata for the relative

period of serv.ice ... .
