Regulations, 1995

iN exercise of the powers confcm:d by section 37 of the Telemalta

Corporation Ac t. the Board. with the approval of the Minister for

Transport. Conununications and Technology and with the concum:nce

of the Minister of Finance, has made the following regulations:-

(I) These regulations may becited as the Telephone Service Ci~ ... ."d

(Amendment) (No. 2) Regulations. 1995. and shall be read and construed <om"",~"o:n'.

as one with the T elephone Service Regulations. 1972. hereinafter L.N . 47

referred to as "the principal regulations".

(2) These regulations shall be deemed to have come into

force on the 20 th February. 1995.

For the purposes of the Value Added Tax Act. 1994. the V.l ...... <Io:IedT"'.

charges specified in these regulations shall not be deemed to be inclusive

of value added tax payable under the said Act. Value added tax shall be "'CI

billed over and above the said charges. as applicable.

Regulation 2 of the principal regu lations shall be amended as ,~~

follows:-

(a) immediately after the definition of "access line'· there

sha ll be inserted the following new definition

" "additional services·' with reference 10 the Packet

Switching Service means optional user facilities which may

be offered from time to time by the Chairman. Telemalta

Corporation. either on a contractual basis or on a per call

basis;";

(b) for the definition of "dial-up access'· therc shall be

substituted the following new definitions

""dedicated access", with reference to the Packet

Switching Service, means access to the Packet Switching

Network by means of a direct link;

"dial-up access", with reference to the Packet Switching

Service means us ing a te lephone and the Public Switched

Telephone Network to gain access to the Packet Switching

Network;";

(c) for the definitions of "X25 Tenninal Subscriber'" and

"X28 Tenninal Subscriber" there shall be respectively substituted

the following ne w definitions

" .. X.2S", with reference to the Packet Switching Service,

refers to a type of access capacity enabling subscriber terminal

equipment which is capable of fonning its own packets to

interact directly with the Packet Switching Network;

"X.28··, with reference to the Packet Switching Service,

refers to a type of access capacity where subscriber tcnninal

equipment is only capable of sending and receiving characters

and therefore requires assistance from a PAD in order to

assemble and disassemble data packets."; and

(d) the defini tions of "CUG" or "Closed User Group".

"logical channel", "NUA" or "Network User Address", "NUl" or

"Network User Identification", "permanent virtual circuit", "port"

and "virtual circuit" shall be deleted.

4, For paragraph (2) of regulation 47 A of the principal regulations

there shall be substituted the following

" (2) The charges appli c able in respect of the Packet

Switching Service shall be those specified in the Eighth Schedule

to these regulations.".

5, For the Eighth Schedule to the principal regulations there s hall

be substituted the following
