Planning Appeals (l-' ees) (A mendment) Regul ations, 1995

IN exercise of the powers conferred by section 60 of the

Development Planning Act, 1992, the Minister for the Environment ,

on the recommendation of the Planni ng Authority and with the

concurrence of the Minister of Finance, has made the follow ing

regulatiOlls:-

These regulations may becited as the Planning Appeals (Fees)

(Amendment) Regulations. 1995 and shall be read and construed as

one with the Planning Appeals (Fees) Regulations, 1993. hereinafter

referred to as .. the principal regulations".

Regulation 3 of the principal regulations shall be amended as

(a) regulation 3 shall be re-numbered as paragraph ( I )

thereof: and

(b) the following new paragraph shall be added after

paragraph (I) as re-numbered thereof

Where the said appeal or request for

reconsideration is made. as the case may be. and such appeal

or request is not accompanied with the receipts mentioned in

sub-paragraph (b) of paragraph (I) of this regulation . or where

it is not accompanied by the amount of the building levy

mentioned in sub-paragraph (c) of paragraph ( I) of this

regulation. the Appeals Board or the Authority. as the case

may be. may grant the peT50n who has Jodged the appeal or

has requested the reconsideration . as the case may be . such

period of time including further extensions of the said time

period as the Appeals Board or the Authority. as the case

may be, may deem fit . to compl y with the require ments

mentioned in sub-paragraphs (b) and (c) of paragraph ( 1) of

this regulation

Provided that if the said person has already paid the

amount of the building levy mentioned in sub-paragraph (c)

of paragraph ( I) of this regulation . it shall be sufficient for

the said person to produce the receipt to the Appeab Board

or 10 the Authority ,as the case may be, showing the payment

of lhe said building levy without the need of effecting the

payment ofthc amount of the building levy mentioned in sub-

paragraph (c) of paragraph (I) or this regulation.- ,

For tne words "as provided in regulation 3" in reg ulation 4 of

the principal regulations thereshall be substituted !.he WOfds "as provided

in sub-paragnph (a) of paragraph ( I) of regu lation 3",

For the words " as provided in regulation)- in regulatioa 5 o f

the principal regulations there shall be substiruted the words Mas provldcd

in sub-paragraph (a) of paragraph (1) of regulation 3".
