IN exercise of tne powers conferred by section 6 of the Census

Act, the Prime Minister has made the following regulations: ~

I . These regulations may be cited as the Census Regulations,

1995.

In these regulations

"Act" means the Census Act

"census fonns" means the forms prescribed in regulation 11

hereof;

"census information" means all [nfoonation necessary for the

making of true and accurate entries in census forms;

"Census Order" means the Census Order, 1995

"Iocality" and "enumeration areas" mean suc h sections of

Malta as may be detennined by the Census Officer under regulation

3 hereof

"midnight ending the census day" has the same meaning as is

assig ned to it in the Census Order.

The CensusOfficcrshall divide Malta into locali ties and where

- - - -. hedeems necessary he may also divide a locality into enumeration areas.

( I) The Census Officer may appoint such number of suitable

persons as he may deem necessary to be superviSOl1i and enumerators

and he shall assign localities and enumeration areas to them as he may

deem appropriate.

(2) Notice of the appoi nt ment of every supervisor and

enumerator shall be published in the Gazette.

(3) Where it appears to !he Census Officer that asupervisor

or an enumerator is by reason of illness or for any o!her reason, unfit

to perfonn his duties under the Act, the Census Order and these

regulations, the Census Officer may appoint some fit and proper person

in his place to perform such duties.

S. It shall be the duty of every supervisor -

(a) to give all necessary instructions to enumerators in his

locality or localities;

(b) to issue to enumerators all census fonns and olher

articles necessary for the taking of !he census;

(c) toellamine, before midnight ending the census day, all

entries made in census forms by enumerntorsand where it appears

upon examination that any entry in any fonn is defective or is

missing, to require the enumerator responsible for completing

the forms to take steps to correct the defective entry or to supply

the missing entry before midnight ending the census day;

(d) following midnight ending the census day , to receive,

examine and transmit to the Census Officer ,all census fonus and

other articles delivered to him by the enumerators of his locality

or localities;

(e) to provide such written reports and certificates with

respect to the work of the enumerators in his locality or localities

and to witness such declarations by the same enumerators as the

Census Officer may in writing require him to do; and

generally to carry out any instructions issued to him by

(f)

the Census Officer for the purpose of taking the census.

It shall be the duty of every enumerator -

(a) 10 meet the Census Ofrtcer or supervisor orthe locality

at such times and places as may be directed;

to keep careful1y any written instructions, books, forms.

(b)

documents. or any other articles or things issued to him in

connection with his duties and 10 deliver them in good condition

upon the tenuination of his appointment or when called upon to

do so;

(c) personally 10 visit at all reasonable times in the period

between his appointment and midnight ending the census day

every housing accommodation in the locality. enumeration area

or areas to which he may be assigned and toobtain all information

necessary for com pleting the census forms;

(d) to make further visits to housing accommodation when

at a first visit the required information can not be obtained. or

which may be directed by the supervisor to revisit for the purpose

of supplyi ng omissions or correcting or verifying doubtful entries

in the census forms;

(e) after midnight ending the census day again to visi t

personally at all reasonable times every housing accommodation

in the locality . enumeration area or areas to which he may be

aSSigned and by deleting, amending or adding to th e entries

previously made in the fonus specified in the First Schedule to

these regulations. to obtain a true and complete account of

(i) all persons who were present at midnight ending

the census day in the said housi ng accommodation

(H) all persons who. at midnight ending the ce nsus

day. were llbscnt from the housing accommodation occupied

by the household of which they form pan; and

(iii) the use which was being made at midnight ending

the census day of all housing accommodation with respect

10 which pllniculars are to be: obtained

(t) if so directed by the su pervisor. 10 assis t in the

performance of the duties of any e numerator in any ()(her locality

or enumeration area;

generall y to carry out such instructions of the Census

(g)

Officer and of the supervisor of the locali ty as may be: issued for

the purpose of taking the census

Provided that in any locality or enumeration area in which

the enuffiCTlItor may be assililoo. at the direction of the supervisor. by

any other cnumeTlltor. paragraphs (c). (d) and (e) of thi s regulation

shall be understood to apply jointly \0 the enu merator of the locality

or enu mel1ltion area and to such other enumerator.

Every supervisor and enumern!or shall. before enteri ng on

his duties. make and subscribe in the presence of the Census Officer

an oath in the form set out in the Second Schedule hereto.

Every person with respect to whom census information is

requi red to be furnished by art icle 4 of the Census Order shall give such

information with respect to himself or herself, upon demand, to a

supervisor or enumerator du ly appointed undc r regu lation 4 hereof and

acting in accordance wi th his duties unde r regulalion S or 6 hereof.

Every person being a person required by article S oflhe Census

Order to furnish census information with respect to other persons Hnd to

housing accommodation shall furn ish such information upon demand

10 a supervisor or enumerator duly appointed under regulation 4 hereof

and acting in accordance with his duties under regulation S or 6 hereof.

Every person with respect to whom it is the du ty of the person

prescribed by article 5 of the Census Order to furni sh census information

shall give the information upon demand 10 such prescribed persons

Provided that any person present at midnight ending the census

day on the premises of any hotel, boarding houSt, guest houSt, hospital,

nursi ng homeorsimilar institution may ,by oral request to the supervisor

or enumeralor of lhe census locality or enumerating area or by written

application to the Census Officer, elect 10 furnish only bis or her name,

status within the institution and sex, to the prescribed person and the

rest of the census information personally to the aforesaid supervisor or

enumerator.

Officer may deem appropriate,
