The Adoption RegulaUon.s, 1995

IN C:lcrcise of th e powers conferred by section 129 of Ihe Civi l

Code , th e Minister of Ju stice has made the following regulations:-

I. lbesc regu lations may be ci ted as the Adoption Regulations.

1995, and shall come in to force on the 1st March , 1995.

The following matters are he reby prescribed for Ihe purposes

of the provisions of Ihe Civil Code hercin afler specified: -

(a) For the purposes of subsection (2) of section 116. the

prescribed authority Iherein referred 10 shall be the: Director

responsible for welfare. The Directo r shall in turn submi t a social

report 10 the court in the interes t of the person 10 be adopted , and

the court shall decide on the applie81ion for an adoption after it has

take n cognizance of the report ;

(b) For the purposes of subsection ( I) o f section 11 8. the

prescribed man ne r therei n referred to shall be a reference to the

num ber which distinguishes the appliclltion filed in favou r of the

person whose iden tity is not known to the conse nting part y and a

refere nce to the da te on wh ich that application was filed ;

(c) For the purposes o f paragraph (b) of subsection (2) of

section 118, the class of person who may allest a docu ment of the

kind referred to in th at subsection shall be any class of person

holding an office which. aorording to the law of Ma lta or of the

place wh ere the document is attested, empowe~ such person to

attest documents at the place where the document is executed ;

(d) For the purposes of subsection (2) of section 119, the

certificate of a regi stered medical practitioner shall be required in

all cases except where the applicant or one of the appiica nts is tne

mother or Ihe father of the person 10 be adopted or where the court

deems proper \0 exempt the applica nt from such a requiremenl ;

(c) For the pu rposes of section 120, the person wh o may be

appoint ed by the Court as special curator of a minor shall be a

pe rson who has attained th e age of thirty-five years and is, by

reason of his experience or office , a fit and proper person 10 act as

such a curator.

The Adoption Regulations, 1966 arc hereby repealed.
