Motor Vehicles (Amendment) (No. 4)

Regulations, 1995

IN exercise of the powers cooferred by section 27 of the Pu blic

Trans port A uthority Act, and by section 17 of the T raffic Regula tio n

Ordinance, the Chainnan of the Public Trnn ~port Authori ty, wi th the

consent of the Min ister for Transport, Comm unications and Technology,

has made the followi ng regu lations:-

I . T hese regulations may be ci ted as th e Moto r Vehicles T1tlo.

(Amendment) ( No. 4) Regulations , 1995,and shall be read and construed

as one with the Motor Ve hicles Regulations, 1994, hereinafter referred ~~u

to as "the pri ncipal regulations".

Paragraph (4) of regulation SOof the principal regulations shall ,,~

be am e nded liS r ollows:-

(a) in subparagraph (b) the reof, fo r th e wo rds " under

Category D" there shall be substituted the words "10 drive a public

tronsport vchiclc";

(b) subparagraphs (c) and (d ) lhereof. shall be renumbered

as subparographs (e) and (t) respectively and the following ncw

s ubparagraphs (c) and (d) shall be inserted immediately afte r

sub paragraph (b):-

"(c) No person shall drive a public trans port vehicle

withou t a lice ncc and not wearing an i<icntification tag issued

by the Authori lY.

(d) No driver of a public tnmspon ve hicle shall make

use o f an iden tific:ation lag other tha n that issued 10 him by

the said A ut hority, and such iden tification tag shall nOI be

transferable from one drivc:r to another:'

(c) in subparagraph(e) as renumbered thereof, forthe words

"under this Category-there shall be substituted the words "under

Catcgory D"'; and

(d ) immediately after s ubparagraph (t) as renumbered

thereof, there shall be inserted the foll owing new subparagraph

(g) as follows:-

" (g) Any driver of a public transport ve hicle

infringing the provisions of s ubpara graph (c) of thi s

paragraph may. while pe rformin g a sc heduled or

unscheduled trip. be stopped from driving the vehicle by an

officer of the Authority o r by the Police. independe ntly o f

any punishment to which the offender may become liable

according to law .".

In regulation 55 of the principal regUlations after the words

"deliver his licence" there shall be inserted the words "and his

identification tag" .

4 . In regulation 131 of the principal regulations. the words from

' The said Authority may prescribe" to the words "from one driver to

anothe r." shall be deleted .

S. Regulation 165 of the prin cipa l reg ulatio ns shall be

renumbered as paragraph (1) thereof and a new paragraph (2) s hall be

inserted thereafte r as folloW8: -

"(2) The content of the tanks of the vehicle may, at any

time. be examined by the Police o r by any officer of the Authority ,

and no person shall cause or penni t s uch vehicle 10 be on the

road, unless the driver thereof i~ canying a key or CKher instrument

to open the tanks of the vehicle.".

In regulatio n 235 of the principal regulations. the wo rds from

''The said Authority may prescribe" to the words "from one dri ver to

another." s hall be deleted.

Regulation 248 o f the principal regulations shall be

renumbered as paragraph ( I) thereof and a new paragraph (2) s hall be

inserted thereafter as follow s:-

"(2) The number given by Ihe Authority shall be pai nted

on the side front doors of the taxicar preceded by the letter "M"

anti in black in the case oftaJr.i cars which are licensed 10 operate

in Malta. and preceded by the leller "G" and in red in the case of

taxi cars which are licensed to operate in GOl.O, in all cases in

those dime nsions as the Authority may so prescribe.".
