IN exercise of the: powers conferred by sections 13 and 16 of

the Environment Protection Act, 1991 , the Min ister for the

Environment has made the following rc:gulations:-

I. (1) These regulations may be cited as the Environment

Protection (ContrOl of Substances Depleting the Ozone Layer) ...... W'K.=_"'.

these regulations shall come into force on the date of publication of

these regulations, and the remaining provisions of all the other

regulatio ns shall come into force on the nex t day immediately

following the e xpiry of three calendar months from the dale of

publication of these regulations.

(1 ) I1 is he reby indicated that in terms of section 13 of the I..istofpotcnlial

Environment Protection Act, 1991 , the D'mtrolled substance ,oDt F'h ..

contained in Schedules A , B, C and D to these regulations, are

potentially tOKic substances,

(2) For the purposes of these regulations, "controlled

substances" means any substance whether existing alollC or in a

mixture and it includes the isomers of any such substance, except

as specified in the relevant Schedule, but excludes any controlled

substance or miKture which is in a manufactured product other than

a container used for the transponation or storage of that substance ,

(3) For the purposes of these regulations, " Director"

means the Official responsible for the Department for the

Protection of the Environment as referred to in paragraph (b) of

section 3 of the Environment Protection Act, I99L

(4) For the purposes of these regulations. " Department ..

means the Department for the Protection of the Environment,

3, These regulations are intended to control the importation,

exponation , use, carriage , storage, destruction or disposal of

controlled substances which are considered to be potentially tOKic in

orde r to limit and phase out these substances in accordance with

Malta's international obligations,

4, No person may impon. eltpon, use, carry, store, destroy or

dispose of any controlled substance unless such person has the prior

approval given in wril ing by the Minister responsible for the

environmenl 10 act in any such manner.

(I) Prior to the importalion of a con trolled substance , the

impo:1cr shall request and obtain pe rmissio n from the Department.

information

following

substances shall be requ ired

(a)

the rou ntry of o rigin;

(b)

the brand name and trade mark, if any;

(c)

the correct chemical name;

(d)

the inte rnatio nally recognized chemical formula ;

(e) the net weight in kilogrammes andlor metric tonnes;

the name of the manufacturer and his address

Provided tha t if the controlled s ubstances fo rm a mixture,

then each substance should be iden tified with its chemical name and

form ula , and the weight of each controlled substance making up the

mixture should be stated.

(3) The final destination of the cont rolled substances shall

also be given by slating the nllrne and address of the user. together

with th e we ight of each controlled subst ance involved. If the final

destin ation is not known at the time of application for permission ,

the address of the place where the con trolled substance shall be

stored or kept is to be provided .

(4) The end use of the listed controlled substances, such

as refrigerat ion, flexible and rigid foams, elec;tronics, and fire

fighti ng (aviation). besides ot her end uses, shall also be stated.

(5) The importation of the controlled substances shall not

be allowed unless all the information required in terms of this

regula tion has been given to the Department.

( I) No controlled sumtance will be released by Customs unle5$

a request for such relnse is aocompanied by the app.-oval in writi n, pven

by tht: Dep<lrtment. No controlled subst ance is to be released out of the

place of temponr)' storage without the prior wrillen approval of the

Department.

(2) The pl~ce of storage, or of temporary storage, or keepin, of

controlled substances is to be open for inspection by the Department. The

Di rector may also speci fy wh ich records arc to be kept with respect to the

slo<:U of con trolled 5Uhstanccs at a place of stor3,e or of temporary

storage.
