IN exercise of the powers conferred by section 45 of the Water

Services Corporadon Aa, 1991 , the Water Services Corporation, with

the approval of the Minister for the Environme nt, has made the

following regulatio ns

I. These regulations may be cited as the Water Services Olltioa.

(Establishment of Penalties) Regulations, 1994.

l. In these regulations, unless the context o therwise requires ,

"the Aa" means the Water Services Corporation Aa, 1991 .

Any person found guilty of an offence against the provisions of

section 43 of the Aa s hall . in Ihe ~ of a fiT5t conviction. be liable to a "."in<r

exceeding two thousand Uri (Lm2,OOO) and , in the ~ of a second or

subsequenl conviaion, 10 a fine (mU/la) of DOt less than four thousand

liri (Lm4,OOO) bUI nOI exceeding eight lhousand liri (Lm8,OOO).

Any person found gui lty of an offence against the provisions of 0Ifet ,.

section SO or of section SI of the Act shall, in the ~ of a fint "IP

conviction , be liable to a fine (mu/lO) of not less than IWO hundred liri 30 _51

(Lrn200) but not exceeding one thousand liri (Lml ,OOO) and , in Ihe ~ of 11 .. Act.

of a second o r subsequenl oonviaion , to a fine (mu/Ill) of not less than

two thousand Iiri (Lm2,OOO) but not exceeding four thousand liri

(1..m4,OOO).

.5. Any person found guilty of any offence against the Act not

being an offence against the provisions of sections 43 , SO or 51 of the

same Act shall, in the caseof a firstonnviction, be liable to a fine (mu/la)

of not less than one hundred Uri (Lml00) but not exceeding six hundred

tiri (Lm600) and , in the case of a second or subsequent conviction, to a

fine (mu/Ill) of nOlless than one thousand five hundred Uri (Lm l ,.500)

but not exceeding two thousand five hundred Uri (Lm2,.500).

Whe re any offence referred 10 in the foregoing regulations is a

con tinuing offence the eourt shall , in addition 10 the fine (mu/la)

prescribed in the said regu lations, award an additio nal fine of not less

than fifty liri (LmSO) but nol exceedin8 five hundred liri (Lm.500) for

every day , or part the reof, during wh1ch the continuance shall have

subsisted, sohowever that the fine (mu/ta) fo r Ihe continuance of the

offence and the fine (multa) awa rded und er the said regulalions shall

oot exceed, in the aggregale, ten thousand liri (LmIO,OOO).

The puniMl menb laid down in these regul ations shall apply

saving any other higher punishment to which the offender may be

subject under any other law,
