and $eClion n of the Local Councils Act , 1993, the Prime Minister has

made the following regul ations

I n these regulations. unless the context o therwise requires -

~ Act ~ means the l.oc:Il Councils ACI , 1993;

"AssociaI KJn" means the Local Councils

Association

established by regulation J of lhe$e regulalions;

~Congre~ri means lhoe Congress of Local and Regional

Authorities of Europe and includes the Chamber of l.ocaI

Authorities and the Chamber of Region al Authorities of the pid

Congress;

"Councillor " incl udes a Mayor.

1bere shall be a Local Councils ASIOcialion with the ai m of

promOling the common inte rests of Local Councils and to represent

Local Councili on international associations of local aovemmcnl

authorities.

( I) llic Association shall llaw: an Executive Committee

c:ompc'5ed of si~ Councillors in office.

(2) The Encutive Commi llce shall in iu firstsillingaftcr iu

election proceed with the election of a Chainnan of the A$$Oclation

from among its o wn members .

(3) There shall be a Registrar of the A$$()(;iation . who shall

be ex offICio the Director (Local Councils).

(ot) 'There shall be an Executive Secretary of the A$$()(;iation

who shall be a public o roccr detailed to perfo nn such functions by the

Minister in oonjum:tion with the Chainnan of the A$$Oclation .

.5. (I) Each Councillor wbo intends to contest the eled ion fo r

the Executive Committcc sllall be nominatcd hy means of a fonn as

establ ished in the first Schedule to these: relulationJ. "The: nomination

fonn 5Ocornpleted shall be handed in personaJly by the candidate to o nc

of the CommiiiSioners I l lhe Eledoral OffICe o n the dates and during the

time established by the Commission fo r that purpose.

(2) Eacb nominalion sball be made 10 tbe E lm orlll

Commission and lhall be Ji&ncd by. proposer who shall be I Councillor

from tbe candidate's own Ic:lQIlity and by two seconders who shall be

Councillors from two localities olber Ihl n tbat of lhe candidatc . 'The

elmed upon tbe principle of proportional repreKntation by mcans of

lhe si ngle transferable vote u separatcly applicable to each of two lists

and from among all Councillors in offioc; and

(b) • Regional List, in which th1'« members are elmed one

eacb from each of the tbree regions set OUI in the Seoond Schedule

to these regulations by and from among all Councillors in offioc

representing Ihe localities in eacb one of tbc rcgions

Provided tbat any onc Councillor may be no minated to oontestthe

same election o nly under o ne specific list , and in the case of an y

oontestatio n made under the Rcgional List , only under tbespecific

region 10 wbich Ihe Counci llo r's locality belongs.

(2) The election sball be held eve ry two yeaTli on the seoond

s.turday in May following a notice to that effect by the CommissioneTli.

(3) Thc Council Secrctary shall act on bebalf of the Electoral

Commission during the voting in his loca lity.

(4) If at the ClI"pi ralion of the time fixed for the rece ipt of

nominationlthe numberof Qlndidalel no minated is equal toar less than

three in the case of the CX=neral List , or only onc in the case of eacb

Regional l.ist , the Electoral Commission $hall declare the candidates $0

nomina ted uel«t.ed .

(5) If at the ClI"piration of Ihe lime fIXed far the receipt of

nominations , the number of f;IIndidatcs nominated is less than t1uee iD

the case of lbe CX=ocral List or none in tbe case of any Rcgional Lisl , the

Commission sball i$5Ue a new notice for tbe clection 10 fill the remaining

Ylcant seall in Ibe CX=neral LiS! or in any Regional List as the case may

be, and if thercupon 110 funher candidates are nominated, or if the

numbe r of candidates nominated is less tban the numberof vacant sellS ,

Councillor or Councillors by the Councillor or CouncilIms previously

(6) V()(ing sball he held in eacb locality in the administrative

offICeS 0( the Local Council between 8.00 I. m. and 11.00 I.m.

Provided Ibal where an Councillors bayc voted, the Commission shall

dose the YOIing in that locality beforc the stipulated time.

Each voter shall VOle on two ballot papen of which one

&hall be made lip of. Gene .... List and the other of 11 Regional List of

eligible candidJilea, ao.:ordin, to the region 10 wbich the voter belongs,

in the form set out in the Third Schedule 10 these rclul.tions, (X)lltaining

I list of CIIndidalCJ described by the Dame (indlldillJ Iny nickname) as

well as the locali ty for which they are CouncilloR.

(8) VoteR shall deposit their hallo!: papel'$ in an envelope

provided by the CommiWon. The envelope shall be sealed by the voter

himself and ilmall be IlWTlped and signed by the Secretary who shall

personally. o n the dosing of voting , immediltcly deliver all sealed

envelopel to the Electoral Commission.

(9) The counti ng of VOles shan slan as lOOT) as all the scaled

envelopes from all the localities have been deposited with the

Commission.

( 10) The results of the elections shall be immediately

notified by the Electoral Commission to the Minister and shall be

published in the Guette ool ialer than two dlys after hYing b«:n so

notified IQ tbe Minisler.

the Congress established by the Council of Europe .

(2) The Minister shall appoint the delegation to the

Congret4, (XImpc:!$ed of representatives and their l ub$tituteli from

among the members of the Executive Committee of the Association .

(3) In appointing the representativel and thei r l ubstitutes,

the Minister shllll ensure that as far u possible regard $hllll be had to

a balanced geographieaL represenu,tion ;

,. (1 ) The Ezecutive Committee of the Aaociation shall

meetings hereunder indicated

member of the Executive CommiUcc: ;

(b) an annual meetiDJ for aU Councillors, excluding Mayors,

to be heldOd the same day as the Meeting in paragraph (I) above,

and 10 be chaired by a member of !be Executive Committee; and

(e) an annual plenary session of Mayors and Counc:illon , to

be ehaired by lhe Chairman of Ihe Elr.ecuthe Commillee.

(2) The Executive Commillee of the Association may

convene other meetings or plenary sessions as il may deem

(I) Thc three members of the Executive Commillee

repruenting the three regions shall once a year as dose as po55ible

to the annual meetings referred to in regulation 9, individually

convene and chair an annual regional meeting of all Mayors and

Coutw.:iIIon of their respedive region .

(2) TIle Exealtive Commillee of the A!lodatioa may

convene O{ber regional mc:etings as it may deem nee " r)' o r

whenever requested in writing by half the persons eligible 10 allend

such regional meetings.

(I) Any twinning between a city, town o r village and

IIICXher locality in any other countr)' "'all require the approval of

the Minister given after the Assoo::i.tioa has given the Minister its

opinion 00 sueh in tended twinning.

(2) In esUlblishing the twinning of Ioo;alitics ,

consideration shall be given to the status of the localities due to be

twinned sueh thltthe capital or former capitals of Malta shall only

be IWinned with a capital o r former capitals of anotheroountr)', and

a city sh.alI only be twinned with another city.

11. ( I) The LoeaI Councils A5SOCiation Regulations, 1994

are hereby revoked .

(2) NOlwithstaIlding the provisions of paragraph (1) of

this n:gulatinn , the members of the Executive Commillee of the

AMociation wno h.ve been voted into offICe by the elections held

on 21 May, 1994sha1l OO11tinuetoboldoffic:eforthe remainingtenn

of offICe under the same termll and oonditions III thole prevailing

under the revoked regulations, and during their fim meeting after

the coming into force of the.te regulations the members of the

Executive Commillee shall decide among themselvCllbout which
