ENVIRONMENT PROTECTION ACT, 1991

IN exercise of the powers cnnferred by sections 6. 32. 33 and 48

of the EnvironrMnt Protection Act , 1991 , the Minister for Ihe

Environment, with the c:onculTence of the Ministe r for Home Affairs

and Social Developmenl. has made the following reg\llations:-

I. (1) ll>ese regulations may be cited as the Protection of Citorioo

Birds and Wild Rabbit Regulations, 1993.

(ii) outside the period mentioned in the foregoing

sUbparagraph (i ). and savi ng the provisions of

regulalion 15 of these regulations. every Su nday and

public holiday after twelve o'clock (12.00 p.m.)

sea, an y time between the 1st of January and the 31st of

October of any year

(Declaration of PrOleeted Species and Nature Reserves) Regulations ,

1993, shall be in accordance with the provisions of these regulations

and without prejudice to any other existing laws and regulations .

unpicked or unplucked .

season, is found in the open countryside, whethe r on his own land

or on land belonging to some other ptf$(ln. or outside such land, or

(2) No person shall take Or attempt to take an~ bird unless

he is carrying the said identity card as well as a licence issued to him

try the Commissioner in tenns of law,

(3) No person sllall tak e or attempt to take. shoot or

attempt to shoot any wild rabbit unless he is carryi ng the idenlily

card refe=d \0 in the foregoing paragraplls of this regul ation as well

;IS a licence issued to him by Ihe Commissioner in terms of law.

No person shall at any time keep or carry a firearm which

is loaded, or with canridges in its magazine, or out of ils case, unless

(I)

Provided that the Commissioner may issue a specia l licence

for the shooting from land of the Tunic Dove (Strepropdill

turtUT) and Quail (CQIUTnU: C(>IUTnu) for the period from the

10th of April to the 20th of May, esce pt on Sundays and public

holidays after ~lve o'clock (12.00 p.m. ), saving the provisions

of regulation 15 of these regulations;

(b) outside the closed season for the shooting of birds not

at sea, shoot or attempt to shoot 8t any bird not included in

So:hedule I to these regu lations;

(c) during tile closed season for the taking of birds not at

sea, take or attempt to take any bird

Provided that the Commissioner may issue a special licence

for the taking lrom land of the Tunle Dove (SITtplopdia IUT/UT)

and Quail (Cllrnmix cOlumix) for the period from the 10th of

April to the 20th of May , escept on Sundays and public 1I0lidays

after twelve o'clock (12.00 p.m.). saving the provisions of

regulation 15 of these regulations;

(d) outside the closed se ason for the taking of birds not at

sea. take or attempt to take any bird not included in So:heduJe

11 10 these regulations;

(e) during the closed season for the taking and shooting of

the wild rabbit, take or attempt to take, by any means, shool or

attempt to shoot wild rabbit

Provided Ihlt during the open season for the laking of the

wild rabbit, the Commis&ioner mly issue a licence 10 an

applicant in po5snlion of a farmer's registration card 10 Shool

wild rabbit on hi s own land dunn" the open season for the

shooting of birds, 5Ohowever Ihal a person in possession of a

(b) :;.hoot or allempt to shoot at sea, by any means. birds

within three kilometrel from the coastline

(c) carry ilt se a, within iI distance of three kilometres from

the coastline, a firearm licensed for shooting game which is Il»ded,

or has cartridges in the magazine, or ill out of il$ case, or the barrel

of which has oot been detached from the rest of the firearm;

(d) shoot o r attempt to shoot &om any sea-craft which is not

registe red with the competent authorities;

(e) shoot or allempt to shoot from any sea-craft unles5 in

possession of a licence for that purpose from the Commissioner

(f) be in possession , while at sca, of any bird , dead or alive,

or part of any bird, nol included in !Khedule III to these

regulations, and any person who is fOllnd in possession of any bird

or pan of Iny bird 001 included in Sehedule III win be presumed to

have shoI:, caught or taken web bird in violation of these

regulations, unless the contrary is proved;

(g) launch, and haul on land , scacratt used for shooting birds

at sea other than from thO$C places indicated in the licence

mentioned in lubparagraph (e) of this paragraph.

(3) No person shall , while in or on any moIor vehicle, be in

possesSiOD of any firearm which is loaded or outside il$ case, or go in

punuit of any bird or wild nlbbi l. or shoot or Itlemptloshool, take or

attempt to take any bird or wild rlbbit.

(4) No penon s.hall carry a firearm, whether loaded or not ,

that is not in its case, or discharge any firearm, while within 200 metres

from any lown or village, or other inhabited area , or wilhin • distance of

SO metres from roads used for motor vehicles, other than OOIIntl')' larK'S

or minor roads which arc intended mainl y for access to fields .

(5) No person shall be in possession of any firearm, licensed

for shooting game. which has a magazine capable of holding more than

two sholS" any time.

(6) The Minister may establish dates for firearms already

licensed for game shooting, which had been impol1ed and registered

with the Commiuioner prior to the publication of these regulations, to

be made 10 conform wilh the req"uiremenu of paT1lgnlph (5) of this

regulation

(7) After the publication of lhese regulations , the

importation of firearms for game shooting shall be made to con form

wilh Ihe provision of paragraph (5) of lhis regulation .

No person shall lake Or allempt 10 lake by any mea ns

whatsoever any bird unless he has a licence from the Commissioner and

subjed locompliaoce with all the conditions specified in the licence and

w;lh Ihe provisions of these regulations.

(I) A bird-trapping licence shall be issued and renewed to .h.· ~_.,.,~.

an applicanl who has • reference from alegally constituted organisation -

represen t;n! bird IT1Ippers.

(2) The t. king ofbirds shall be earried out only by the useof

tT1lditionl1 neu known as dap-rK't consisting of IWO neu spread flat on

the ground which take birds by clapping over each othe r on the ground.

(3) The taking of quail ean be earried out by the traditional

quail net spread on the ground.

(4) The largest size of each nel sha ll not in any case exceed 45

feet by 9 feet or 1).75 metres by 2.75 metres.

(2) No penon shall exhibit . import or ClIport, carry or offer

for sale, orbe in possessionof any bird whether .llveor dead, orpa rt of

any bird which is not included io Schedules I, 11 or III of tbese

regulations. unleu he proves that such bird WlIslawfully imported or

was bred in ea~ivily .

(3) Only soch birds , dud or alive, or parts thereof, may be

imponed I1 cln beshown 10 have: b«n bred in captivily in their oountry

of origin, or which are not protected in their country of o rigin, o r the

exponalion of which is authorised from the country of export.

( I) No pcnon shall lake or auempt 10 lake, Shool or

(c) nets, including those known as rtll1jG, mist· nel$, and an~

t~pc of vertical net, bu t not those referred 10 in pangraphs (2), (3) ,

(4) of regulatio n II and in p;mr.graph (1 ) of regulation 18;

(2) No person shall shoot at o r attempt la shool, take or

21. Turdw iliacw

( I) No pennn shall act as a bird-ringe r without a licence

from tile Commissioner issued to him in accordance with the provisions

of this regulation .

(2) No person ot her than a bird-ringershalltakc any bird for

the purpose of ringing or marking it.

(3) No person may use a ring on any bird naturally occuring

in the Maltese islands other than a ring approved by the Minister.

(4) A bird-ringer may take any bird for ringin80r marking at

any time oflhe day or of the year, and may also take such bird for such

purpose in a nature reserve.

(5) A bird-ringer who takes a bird \0 ring or mark it shall

release it immediately he has so ringed or marked it and taken Ihe

necessary infonnation.

(6) A bird-ringer who takes a bird \0 ring or mark it. or 10

examine any ring Or mark on the bird , may use a mist-net , or any other

method approved by Ihe Minister.

(7) Mist-nets are 10 be imponed with the approval of the

Minister, who shall keep a record of bird-ringers who use them, as well

as the number of mist-nets in their possession.

(8)

No bird-ringer can use live birds as dcroys.

(9) Besides the licern:e mentioned in paragraph (1) of this

regulation an applicant shall

(a)

obtain the authority ofthe Minister;

(b) have a trainingceniflcate from a ringing scheme whieh is

accepted by EURlNG - t he Europe an Union for Bird Ringing;

(c) have the approval for a licence from a bird riDging

seheme recogn ised by EU RING ;

(d)

not be in possession of a shooting or trapping licence.

21. (I) Except as provided in paragraph (4) of regulation W of

these regulations no person

(a) shall shoot , injure , lake or try to shoot, injure or take any

bird or wild rabbit in a nature reserve;

(b) shall . at any time and by any means whatsoeve r, have in

his possession or under his control any bi rd , dead or alive, or an y

wild rabbit , dead or alive, or pan of a bird or wild rabbit . in a nature

rese rve;

(c) shall have in his possession or under his control , any

firearm, ammunition, decoys, net or any other means to shoot or

take any bird, or the wild rabbit in a nature reserve

Provided that the foregoing shall not apply to any shooter

or trapper who, while on a moving ve hicl e, is carrying a firearm

which is unloaded alld without any canrid'e$ in the maguine, and

inside ils case. or who has nelS for laking birds while passing

through the main roads of a nature rese~.

the limits indicated in paragraph (4) of regulation 9 of these regulnions.

(2) If such owner, tenant, user Of" possessor fail!i 10 comply

23. Not hing in these regula tions is intended 10 affect clay-pigeon []ay.,...,..,

and held actOrding to a licence and conditions laid down by the

Commissioner, provided that all participants are in po5§ession of a

licence to carry a firearm.

24. The Minister may. for any scientific. veterinary or OIher Gmt<oi

similar purpose, or for reasons of public health 0<" safety give authority .. ; ' -

to shoot at, take or keep any bird Or wild rabbit.

25. Any pcrsoo: -

(a) who fails to comply wi th any provision of these

regulations or with any order lawfully given in terms of any

provision of Ihese regUlations; or

(b) who contra~eneli any reslriction, prohibition

or

requirement imposed by or under these regulations, or

(c) who acts in contravention of an y provision of these

regulations ; or

(d) who conspiru or attempts, or aids , abets, counsels or

procures any other person 10 contravene the provisions of these

regulations or to fall to comply wilh any 5UCh provisions (including

any order lawfull given ID terms of any provbion of these

regulations) or to contrave ne any restriction, prohibition or

requiremen t imJlO5Cd by o r under the said regulations,

shan be guilty of an offence against these regulations.

(2) Any person who commits an offence against these

regulation s sh all be hable

(a) on a firsl oonviction , to a fine (multa) of nollas than fifly

from holding or obtain a !ieena:, permil or authority shall in no case be

for less than one year.

(4) Notwithstanding the provisions of sect ion 370 of the

Criminal Code, proceedings for an offence againsl1hese regulations

shall be taken before the Court of Magistrates (Malta) Or the Court of

Magistrates (Gozo), n Ihecase may be, and shall be in ac<:Ordarw:e with

the provisions of the Criminal Code regu lating the procedure before the

sai d courts as cour!s of crimina! judicalUre.

(5) Notwithstanding the provisions of the Criminal Code,

the Attorney Genera! shaH a!wayshave a right of appeal to the Coun of

Criminal Appeal from any judgement given by the Court of Magistrates

(Malta) or the Cour! of Magistrates (Gozo) in respea of proceedings for

any offence again st these regu lations.
