Drink ing Water Act. the MiniSlcr for Home Affain and

Social Development, 00 the advice of lhe Food S,&ndiUds BoiIrd , has

made .he following rc:gul.lions:-

I. These regulations may be cited as the Labelling and

Presentation of Foodstuffs (Amendment) Regulations. 1993 and shall

be read and construed as one wilh the Labelling and Prc:sc nla lion of

Foodstuffs Regulations. 1992. he reinafter refe rred 10 as ~Ihe principal

regulalions~ .

For paragraph 1,1 of the principal regulations there shall be

substi tuted the (ollowill&: -

.. 1.1. These regulalions may be cil~d as tile l abelling and

i>resent;llion of Foodstuffs Regulations. 1992,"

l . For paragraphs 4.3. 4.3. 1 and 4.3.2 of tlK: principal IeguLations

tllere sllaU be substituted tile fo11owing: -

"4,3. The name of th e food must include Or be accompanied

by an indication. as is appLicabLe to such food. that a food is

powde red or is in any other physical condition or has been dried,

fn:eze dried. frozen . concent rated. smoked or subjected to any

other treaUTleIll. if. in any case. omission of sueh statement could

mislead or confuse the p u rchas.cr.~.

In paragraph 7.4 of tlK: principal reguLations. for the ... ·ords

"Each con tain ershaU beembossed" there shall be substi tuted the words

"Each cont ainer whicll comes into direct contact witll tile food shall be

embossed".

S. Regulation 100fthe principal reguLations sh.all be amended as

follows -

(3) in paragrapll \0. 1 thereof. for the words "When: the

containe r is covered by a wrapper: ' there shall be substituted the

words "Save as provided under parngraph 7.4 of these regulations.

where tl1e container is oovc red by a wrapper."; and

(b) for paragraph ]0.3 tl1ereof. there shall be substituted the

following -

" 10.3. Subject 10 the provi sions of paragraph IO,S of

thcse regubtions. the namc. net con tents of the food. any

dedara tion as \0 durability of the food . and. in the case of

beve ... ges containing not more than 1.2% alcohol by 'iOIume

also the actual alcoholic st rength by volume. shall appear in

Notwithstanding any other provision of these

~gulations . only the name of the food, the net contenl$ and a

declaration u 10 the durabilily of the food if any, shall be

requi red when food is sold in -

(i) a glass bottle which i~ ~tu mabJe and ~fill able

for re·use for the purpose it was origin aU y intended. and

which is indelibly marked with one or other of these

~quirements; or

(il) a container. the largest surface: of which has an

area of less than ten squa~ centimetres.

IO.S. With effect from the first day of January200J, Ihe

illformation required under pa11lgnlph 10.4 of these

~gulation s shall , in respect of the ~lative food , appear in Ihe

same field of vision.

6. For the purposes of these: regulations, the wbole

crown cork or cap shall be deemcd as being in the same line of

vision as that part ofthe bottle on which the other information

is presented.

6. Forparagraph,20. 1 and20.20rtheprincipal ~rulations, there

shall be substituted the following -

Provided tbat the Superintendent of Public Health ,

may . subject to any condition he may impose in respect of security

of the food , allow any prepacka4ed food which is not labelled in

one of the languagel ~ferred to 111 regulation 10.1, 10 be taken to

such place u he may direct. for the purposes of additionallabdling

in one of the prescribed languages, subject to such additional

labelling being a lion" full t11lnslation of the origin al label in rcspe<:t

of the requirements of thcse regulations.

2 Nofoodshall be imported into Malta unlessthe daleo{

minimum durability is such that -

(i) in respect of food having a shel f life of si~ months or

less, such food sli ll has atleasl fifty percent of il$ shelf life afte r

its relcase from CUSloms Authorities: and

(ii) in respect of food having a shelf life of more than si~

months, the date of minimum durability is AOI Iess than th~e

months away from dale of such release

date of minimum durability. For the purpose of determining the

date of manufacture , it shall be lawful for the Superintendent of

Public Health 10 require Ihl \ the product be accompanied by a

manufacture is not shown on the labd .

Provided Ihat in respect of ordcn made before

the thirty fint day of December, 1992, all the provisions of

these: regulations shall, in respect of imported foodstuffs,
