(I) TIle species of marine mammabdeclared to be prolec:1ed ~oI

under KcWn 32 of the Ad shall be those li sted in the Schedule to Ihese .....

regulations.

(2) No person &hall punue. take or atlempt 10 like, kill or

attempl to kill, possess, sell by any method , buy. exmange. import or

eqx.rt any of the specie(! , or any part or derivative of such species,listed

in the Schedule 10 lhese regulations.

(3) ABy penon who shall possess any Jp"rimen before the

oomin,

inlo force of lhese regulalionllhllll repmr such specimen wilh

the Director re$ponsible for fuherie5 wilhin three months from the

publiatioo of these regulations.

(4) Any marine mammal accidentally cauahl by fisbenncn

during their IIOrmal fishing aclivities and landed at the fish market in

Valletta, shall be sUTTendered immediately 10 the Director responsible

for fisheries who shall then dispose of it for IlCientifie purposes only. and

in sudl ca.ses, the fisllerman shall be compenaated for any lassof tackle

or income as fixed from lime to time by the Director responsible for

rlSheries.

Any penon who has in hispouession any specimen the import

of which is subject 10 these or other replatioos, shall retain in his

possession, and until sucb time u that specimen remains in his

,x: I ""ion, all permits , cenirlClle(l ancIlicenca relative to the import of

that specimen.

(I ) l1Ic Director may iauc permiTS for the takiq and

keeping of any speci ... lisled in tbe Schedule to these regulations if such

appliations are intended for OOIUl /Ullllcicntifie studi ... or other similar

purpose .

(2) All sucb permits shall lapse al the end of the calendar

year. and have 10 be renewcd prior 10 the beginning of the following

year.

g. The Directo r may prohibit lhe importation of any s;peQeII of ::,,:,:~. '

marine mammals if, in his opinion, sud! tmic can lead 10 the

endangering of the biological identily of these island$ or their lerritorial

wllen .

any reslriction , prohibition or requirement imposed by or under these

regulations , and any penon who conspires or Iltempts . or aids, abets.

offences. shall be guilty of an offence.

(2) ABy person who commill an offence against these

regulations shall, on convietion. be liable to a fine (mu/IQ) of 1101 IeIII

than Lm2S for a fint offence, and not more than LatlOO for each
