has made the following TC:gulations:-

I. These regulatioDS may be cited as the Reptiles (Protection)

Regulationl. 1992.

In these regulations, unless lhe renin! otherwise requires: -

MAct~ means lhe EnvironmcT11 Protection Aa, 1991;

M Director~

means

the Din:ctor responsible for lhe

environment , and includes any offia:r in hi$ Departmen t who is

authorized by him to act on his behalf;

MCKpon- means the lakinS out of Malta of any specimen;

kimport" means the bringing into Malt. of any specimen

~ M inister~

responsible

the

environmen t

kperson - includes any pcl'5Oll or body of persons acting under

the instructions of any em ployer , masler or owner

Mspecimcn" means any reptile specified in the Scl>edule 10

these regulatiolls, of whatever Speciel, whether living or de.d ,

whether whole or in part . whether in the orignal form or after

having undergone any transfonnation. wherever found in the

Maltese islands and their terTitorialwatel"$ ;

J. 1be $pecie$ of reptiles listed in the Schedule to these

regulations Irc declared to be species of reptiles protected for the

purpose of section 320t the Act .

(I ) The Di recto r sllall be responsible for the administration

and implcrnc:n ullion of these regulations .

(2) The Dircdor shall have such righg asare listed in section

49 of the Act .

(3) The Minister may at any time order the Commissioner of

Police to tat esuch immcdiateaction as may be requ ired to preven t any

peT$On from acting in cont raventio n of these regulations .

( I) TIle species of reptiles decland 10 be prot«:led under _Iooof

(2) No person shall punuc, take or allempllo lake, kill or

attempt 10 kill , possess, seU by any method , bu.y, el(ehange, import or

upon any of tile species, or any pan or derivative of such species.lisled

in the Schedule to these regulations.

(3) Any pef$Oll who lhall fJO!S$e$$ a marine lunlc prior 10 the

eomina inlo force of these regulations shaD register lioch marine lunle

wilh the Director responsible for fis heries within three IlK)nll\s from the

public:ation of these n:guiations.

(4) Any marine lurtle accide ntally caught by fishennen

durinl their nonnal fIShing activities and landed al the Ihh market in

V,lIeUI, shall be sum:ndered immediately 10 the Director responsible

for fisheries who shall then disp<l5e o f it for scientific ptlrpoKI only, and

in 5uch cases, the f'ishcrman shall be COIllpenuted for any 1010$ or tackle

or iDCDnte as fixed from lime 10 time by the Director responsible for

fisheries.

, . Any person who has in his posscsioo any specimen the import

of which is subtca to these or other regulations, shall retain in his

I" Ilession and until such time as that specimen remains in his

posseuion, all pennits, ce rtificates and licences relative to the import of

that specimen.

1. ( I) The Director may iss...e permits for the laking and

keeping of any species listed in the Schedule 10 these regulations if such

applications arc intended for 00'"' fitU scientific studies or other $imilaT

(2) All such permits shall lapse at the cnd of the calendar

year, and have to be renewed prior 10 the beginning of the following

year.

The Director may prohibit the importation of any Spceiel of

reptiles if. in his opinion, such trade ca n lead to the endangering of the

biological identity of these Wands or their territorial ~teTS.

(I) Any penon who shall take. tr.ill, po<5I'S', sell by any 0"

method , buy , exchange, import or export any specimen in F t " ·

contravention of these regulations , and any pcnon ... ho c:ontravellCl

any restriction, prohibition or requirement imposed by or under these

regulations , and any person who conspires or attemptS, or aids, abets.

c:oun5Cls or procures any other person to commit any of the above

offences, shall be guilty of an offcnce.

(2) Any person who commiu an offcllOC against these

rcgulations shall, on conviction, be liable to a finc (mult4) or not Ie$I

than Uli2!5 for a first offence, and not more than UliIOO for ckh

subsequent offence, which fine shall in each case apply 10 each specimen

involved.
