m~ the following regulations: -

I . (I) These regulations may be cited as the Yachting Cen tres

Regulations, lm.

(2) These rclulalions shall rumc into force on the 1st

August , 1992.

I n these regul ations, un less the context otherwise requires -

water and electricity charges.

D) Where a yacht of size A 10 G is berthed on melTed quays, a reduction of

7c per metre per week will be allowed.

E) A 30% surchage will be levied on ~achlS that are ~Iived upon ~ on

ponloon berths.

F) The winler conlnCl coven Ihe period from I October 10 30 April whilst

the summe r conlract covers the period from I Ma~ to 30 September.

authorised by him in writing to act on his behalf;

Mserviced quayM means a quay where water. electricity and

telephone services arc availahc ;

pleasure and accepted as sudI by the Exccuti~ Director;

a yachting centre under regulation 3 of these regulations.

All Ihe positions mentioned above are on a European Dawm.

Yachts berthi"g and usi ng the facili ties of a yachting centre

shall do so in accordance with the provisions of these regulations .

No vessel other Ihan a yacht may bert h al or use Ihe facilities of

a yachting centre unless specia!ly authorised so to do by Ih e E~eculive

Director and. in an y such case, th e provisions of these regulations sh all

apply to any such vesse L as though it were a yacht.

(I) Yachts shall bert h Or mOOr or shift berth at a yachti ng

centre as, where and when directed by Ihe Executive Director.

(2) The master of a yacht shall be responsible to ensure that

the yacht is safely moored in a proper manner at all times when berthed

or moored at a yachting centre.

(3) In the absence of the master of a yacht, the Executive

Director shall have the right to adjust or alter its position Or 10 remove it

to any other be rth or mooring, at the risk and expense of th e owner of

the yacht.

No yachl shall be moved from one berth 10 anothe r within a

yachting centre without the prior authorisation of the Executive

Director.

A yacht relinquishing ilS berth for a time in excess of 24 hours

shall forfeit the right 10 that berth unless the Executive Director, upon

prior notice of absence from a yachting ce ntre, ot herwise directs.

The owner and Ihe master of a yacht shall at all times be

responsiblc for tbe safety of thc yacbt and they shall be liable in solidum

for any damage caused by the yacht to a yachting centre or its facilities.

or other refuse into tbe waters of a yachting centre.

Provided that the Executive Director may , in his discretion.

a limited period of time subject ot the payment of a fee specified in

the Schedule hereto for crafts so authorised to be kept on a quay;

Provided that the Executive Director may, in his discretion ,

Notwithstanding the provisions of regulation 3 of the Speed

Boats and Water Siding Regulat ion s. 1985. no person shall cawe or

permi t any craft to proceed I t a s~d ill e~ce$S of five knots within a

Ylchting cen! re .

Owners and maslers of ~achtli in rcspe<:t of which allY fees ,

charges or rat es are due Mall notify the: Executive DiT«lOf of their

inlelltion 10 leave the yachlingcentre nOl later Ihan 24 boursbefore the

exp«ted lime of departure

Provided thal sueh noticeshall nol be dee med to have satisfied

lhe: provisions of any other law or regulation relaling 10 lbe

dearance outwards of ve~ls.

Th e Execulive Direetor ~hall nOI be liable in respcel of lossof, Il1o<IIti ..

or damage 10, any yacht. its furniture , stores, maehil!ery or equipment ' ~­

occurring for lIIycausc: whatsoever while il is al a yadllingcentre .

( I) Berthing or mooring space in a yaehti llgcentre may be

reserved by the Execlltive Director for an y yachl al the requeSt of its

owner or masler and upon Ihe payment of a booking fe<: equivale nt 10

onc we<:k's berthing fees. Such a fe<: shall nol be reimbursed under any

circumStlllceS.

(2) Where any such space is 001 laken up by the yacht for

which it was reserved within seven days of the dale from which tile

reservatiQn was 10 take effect, the Executive Diredormay re-allocate it

10 olher yachts

Provided that, in any caM: of proved foroe majel,lrc, the

Executive Director may , in hisdiscretion,eJrlend the said period of

seven days as he will df:em proper.

Yachts shall at ali limes Oe under the charge of a master orof

any other person or persons duly authorized 10 assume full

respoll$llbility for tbe yacht

Provided that the owner Of the mute r , as the case may be , of

any yacht shaD submit 10 the EJ:eculi~ Director the nBITK: and

address in Malta of the person or pcl"5ON aulhoriled 10 take charge

of tile yacht before charge is taken by any such person or pcrrons.

20 . There shaU be paid in advance 10 tile EUClilive Director in

respect of each yacht berthiog or mooring in a yachting centre a fee as

specified in t he Schedule hereto.

reBulalions shall be guilly of an offenCC' and shall be liable, on

conviction. 10 a fine (mU/ill) nOI exceeding onc hundred Maltese liri m-

10 imprison menl for a lerm not e~ceedi ng three months or to both such

fine.oo such impriiiOnment and. in the ease of a continuingoffencc, he

shall moreover be liable to an addi tional fine of not more than five

Maltese liri for each day duTin, whieh weh cont ravention continues.

The YlK"hting Cenlre Regulations, 1967 are hereby revoked.
