IN exercise of the powers conferred by subseelions (4) and (.5 ) of

section 9 of the Maltese: Citizenship Ad. the Prime Minister has made

the following rules:-

These rules may be ciled as the Deprivation of Mallese

C it izenship (Commillee of Inquiry) Rules. 1991.

2 . (1) The Committee o f Inquiry, henccfonh in (liCK Rules 10

be called " the Committee" . shall be composed of _

(a) a Chairman 10 be appointed by the Minister responsible

for matters relating to Maltese citizenship from among the judges of

the Supe rior Courts or perwns who have held the office of judge of

the Superior Courts;

(b) two members appointed by the sa id Mi nister. one of

whom shal1 be a public officer, and the ot her a person who is or has

been qualified to be appointed magistrate: in Malta.

(2) The Chai rman and the appointed membc~ of the CQm -

minee shall hold office for a term of three years and under such cond i-

tio ns as may be set out in their letter of appointment.

(3) The Chairman and the other membcrsof the Committee

shall . on th e expira tion of the term of their offICI:. be eligible to be

rea ppointed .

(4) When any vacancy in the Committee oo:cul"S. the Minister

responsible for matters relating to Maltese cilizcJll;hip shall. as SOOfl as

practi"!8ble. appoint anothe r person to fill the vacancy.

(5) A mcmber o f the Committee maybe removed from office

by the Prime Min ister . but such member may be remm'ed only for

(6) Save as otllerwise e~pressly provided by these Rules. tile

Committee may make ils ()\\'n rules and otherwise regulate its ()\\'n

procedure.

( I) The Chairman and any membe r of the Commillee may

abstain from sitt ing or may be challenged for anyof thccauses men tion-

ed in 5eClion 734 ofl hl: Code of Organization and Civil Proced ure .

(2) Any q UC5tion rega rding a cause of abstention or

challenge. and any question regarding procedure. shall be decided by

the Chairman oflne Committee.

(\) The Minister l'e$ponsible for maliC" relating 10 Maltese

duties.

(2) The Secretary of the Committee shall ha\·c. mU/a/is

and Civil Procedure vested in or imposed on the Registrar of the

SuperiorCourts.

(2) Sum monses for attcndance of witnesses shall be in thc

Chai rma n o r Secre tary of the Commillce.

(I) The Committee sha ll hold its sitting.~ in one of the Hulls

of th e Cou rts of Justice in Vollctta.

(2) The Expatriates and Nationali ty ])ivision of the Office of

the Pri me Ministe r shall be the Registry of the Commill ce, and the rein

shall be deposited and ke pt the records of th e Committee, as we ll a~ any

writte n com muni catio n or submission to be filed wit h the Secn:tory

the reof.

( I) An y notice, warrant or order iss ued by the Committee

shall be signed by the Chairman and coun ter·signed by the Secretary .

(2) The Committee may, at any time, allow any amend ment

to be made in the application for the purpose of ma king it cleare r.

(3) Notice of the day and time appointed for the hearing of

the inq uiry shall be given to the aggrieved person in the Form]) set o ut

in the Schedule he reto.

(4) The aggrieved person may be assisted d uring the hearing

of the inquiry by a lega l practi tioner.

(I) Save as otherwise provided in these Rllles. the decisions

of the Committee shall be taken by 11 majority vote_

(2) The decisions of the Committee shall be in writing and

shall be signed by the Chainnan and by the Secretary. and the original

shall be kept by the Secretary of the Commiuee together with the

complete record of the proceedings of each inquiry.

Any application made in whatever form in (cnnsof subsection T" n.itory

(4) of section 9 of the Maltese Citi:/:enship Act, before the coming into J>fO'"i.ion_

forcc of these rules. shall be deemed 10 have been made. and to be. in

accordance with paragraph (2) of rule 3 of these Rul es.
