IN e xen.: ise of the powers conferred by section 2 of the Fees

O rdinance , the Minister of Fi nHllce and the Minister for Development

of Infra5lruet ure have made the foilowing regulations:-

These regulations may be ci ted as t~ Fees (ElIHmi nation of

Video and Cinematographic Materia l) Regulations. 1990.

(1) There shaH be charged by the ComptrollcrofCustoms or

by the Po>tmaster Gene ral. as the case may be , for the eumi na tion of

all types of video recordi ngs. exposed ce ll uloid film. and any othe r

similar type of materia l. the following fees

(i) on every item. profcssionalJyproduccd and ofa

comme rcial nature. including programmes a nd films

recorded abroad from foreign te levision stations ....... Lm 1.00

(iil on uery item of a purely personal na ture.

relating to family events a nd social occasions. and

intended for domestic pu rposes. and not inte nded for

resale ............... ....... .... ... .... ...... . .... ....... ........ ... LmO.50.

(2) An y fce charged under paragraph (I ) of th is regulation

shall be levi ed once only for the exami nation of ide ntical eopies of the

$lime material imported in the same consignment.

not be payable if such material consists of the fo ll owing

(a) video recordings. exposed celluloid fil m or any ol he r

si milar type of materia l of an educatio nal, scie nt ific o r cultural

character prod uced by the United Natio ns or any of its specia1i~ed

agenCIeS; or

(b) vid ~o recordings. exposed cell uloid film or any OIher

simila r type of material of an educational nature imported b~ lhe

Un i versit ~ of Malta: or

(c) video record ings, exposed cd luloid film o r any othe r

si mil ar type of ma tcrial of an educational na tu re imported by

private schools. provided tlwt the Director of Educa tion cerlifie s

that -

(i) such school is licensed by the Government , and

(ii) the materials are solely of a n ed ucat ional natu re and

are to be used solel~ and ent irely by such school fo r

educational purposes; or

(d) video n:rordings, exposed celluloid film or any othe r

simi lar type of mll1crial for language courses.

The Fees ( E~amination of Video and C incmatogr~ph ic Mate rial)

Regul ations. 1985 arc hereby revoked.
