IN exercise of Ihe powers conferred by sections 3 and 4 of the

Govcrnmell1 Loncries Act. 1981. the Minister of Finance has made the

following rcgulations:-

(I) These regulations may be cited as tile Government

Lolleries (Super Five) Regulations. 1990.

(2) These regulatio ns shall come inlO forte on the 18th

Jan uary. 1990.

In these regul ations unless tile context othe rwise requires--

-age nt'" means a person who is au thori ze d by the Directo r 10

accept and validate ti cke ts on bc halfofthe st akerfor th e purpose of

forwarding them 10lhe Department for cntl')' in a panicula rdraw;

~c1aim period" means the period following a draw within

which (he slaker in po!iSCssion of a wi nning ticket may claim a prize;

~Depanment" means the Depanme nt o f Public lotio;

~ Director~

means the Director of Public LoIIO and to the

extent of the authority given. incl udes any officer o f the

Depa n men t authorized by the Director in that behalf for any

purpose of these: regul ations;

means the extraction at random by physical.

mechanical or electronic means. of five numbers from onc ( I) to

thirty·silI (36) which give the righ t to the stake r of a ticket bearing

"machi ne numbcr" means t he number o f the selling point

computer term inal;

" main computer" means th e com puter system sit uated at the

Depart ment or ot her location as indicated b)' the Director. and on

whi ch all information with regard 10 tickets panicipating in a draw

is read and stored and may be retrieved for further processi ng oft he

draw ;

" Min iste r" mean s the Minister responsible for Finance and

includes, to the exten t of the authorit), gi vcn. an)' person

authorized by the Min iste r in that behalf for any purpose of 1iM:se

regulations;

"selling point" means the offices or any branch or section of

the Department or the place of business of an authorized agent al

which tickets for the dmw can be sold ;

~stakerM means the person in possession of a 'Iulid ticket i§sued

tlirough a leoninal;

"terminar means the data capture machine situated al a

se lling point or office from which authorized sales can be made ;

- ticket" means the ticke t printed by a terminal and bearing the

followi ng infomlalion

(a)

an identifying draw number fo r a draw in a particular

wee k;

(b) the machine number or the age nt num be r of the

relevant iclling point terminal ;

(c)

the ticket registra tion number ;

(d)

the Sla ke paid; and

(e) five d ifferent numbers from onc (I) 10 thirty-six (36)

as selected by th e stake r.

J . (I) The draw of the game shall be held eve ry Wednesday al

noon . or as soon as possible thereafter. al such place as I he Minisler may

holiday. the draw for that particular week shall take place on the

preceding day and if such a day is also a public ho liday. then the draw

~hall be held on Ihe following Thursday.

S. ( I ) These regulations and condi tions shall apply and shal l be

bind ing on all sta kers as soon as payment of th e relalive stake is made.

(2) A copy o f these regulat ions shall be avail ab le for public

vi ewing at t he Departme nt and at the place of business of all agents.

(1 ) The price of e ach stake shall be 50 cents and a licke t shall

be issued for each stake.

(2) An unlimited number of sla kes may be made by anyone

staker al any onc lime in respect of a particular draw.

(3) A ticket shal l ha~ five numbers from (I) 10 thirty-si x

(36) registe red on il.

(4) Rece ipt of the ticket by a slaker shall constitute an

ackno wledgement Ihat the numbers thereon arc the player's selections.

It is the responsibilit y of Ihe st aker to e nsure that th e numbers primed

on the ticket arc correct before: leaving the ~ lIing point.

(5) A pLayer participates in the draw when the releva nt

informat ion about his stake is deposited al the Department by th e

authorized agent . and afler it has been entered in lhe main computer. If.

for any reason whal$OCvc:r . such information is n01 received and entered

in the main computer al the Department, the related Slake$ aTC

automatically invalidated and th e staker is entitled only to a refund

equivalelll to th e amount 51aked after presentation of the rc1eV31l1

tickets.

(I) Notwithsta nding anyth ing contai ned in these regulations

or any other law. the agel1 t shall be deemed to be ol1ly the agent of the

stake r for the purpose of forwa rding information regarding stakes to be

stored on data ca pturing machines at tne Department or for the pu rpose

o f validating inform ation about stakes while aS$ist ing a staker to

participate in the draw ; and the agent shall not, for these puTp0§C5. be

acting as an age nt of the Department.

(2) The Minister may from time to time specify different

comm iS$ion rates payable to agen~ by the Departme nt in respect of

sales and in respect of cashil1g of winning tickets.

(3) The tickets participating in the draw shall only be those

stored in the main computer at tm. Department.

(4) If particulars of tile ticket in tile poS$CS$ion of the staker

differ in any wa y from the main computer reoord , the player shall be

bound by the Department's prite determ in ation calculated on tm.

(5) A ticket which has been recorded as void on the dala

capturil1g media oflhe main computer shall be deemed as void and orno

validity in claiming a pri~e and the sta ker shall have 110 claim against the

Department. whether such void reco rdin g is attrihutable to the staker .

to a malfunction of the computer system o r by reason of operator error.

( I ) From the total amount of sa les made in respect of each

game. ten pe r centum (1 0% ) o f such amount shall be allocated for

commissions due to age nts and for subsidies that may be allocated for

sporting activities or ony such activities as the Minister may determine

from tim e to time. Forty-five per .:cntum (45 %) of lotal sales shall be

allocated and paid by the Departmen t \0 a pri ze fund. and the prite fund

shall be distributed as follows

Division 1- Fifty per centum (50%) of tile prize fund;

Division 2 - Twenty per tentum (20%) of tile prize fund;

Division 3 - Thirty per centum (30%) of the prize fund .

(2) The tllree prize winning divisions in eacll game sllall be

allQ(:ated as follows

Division I - as dividend for tickets lIaving five winning

numbers in anyone game;

Division 2 - as dividend for tickets lIaving four winnin,

numbers in anyone game

Division 3 - as dividend for tickets having three winning

numbers in any one games.

(3) Division I winnerscannOl claim Division 2 or Division 3

dividends. and Division 2 winners cannot claim Division 3 dividends.

(4) If in any Division there is more than one winning ticket.

the prize money allocated to that Division shall be apportioned equally

according 10 the number of winning tickell; in that Division.

(S) The Di rector may release the name and place o f

residence of Division 1 prize winners in each game unless the stake r

instructs the Di rector orherwise.

(6) If in any draw. the re is no Division 1 prize winne r. the n

fi fty per ce ntum (50%) of the Di vision 1 prize fund in that draw shall be

added to the Division I prize fund of the next immediately following

draw . The remaining fifty per cenlum (5O'YQ) oflhe Division I prize fund

shall be allocated to the Division 2 and Division 3 prize fund of the

current draw in the following proportions

Forly pe r centum (40%) to Division 2 winners, and

Sixty per cen tum (60%) to Division 3 winners.

(7) If in any draw there are no Division 2 prize winners. then

the Division 2 prize fund of that draw will be added to the Division 3

prize fund and shared equally by all Division 3 prize winners of that

(I) Winning tickets are to be presented for payment within PrIze

thirty runn ing da)'$ from tile date of tile respective draw, provided that if ononey.

the last day for claims falls on a Saturday, Sunday orpublic holiday. the

claim period shall be extended to the following first working day .

(2) Division I prize winners mUSI presen t their winnin g

ticke t during the prescribed period al the Depanmenl and du ring the

lime 1.$ iodkaled by the Ministe r from lime to ti me .

(J) No prize money shall be paid un less the relevant .... inning

ticket ispresenled.

(4) Unl ess otherwise instructed by the Minister or by Ihe

person presenti ng a winning tic ket. the prize money shall be paid 10

whoever presents Ihe winning ticket. The payment of any prize won by

a Sla ker on such a ticket shall be deemed as a full discharge by the

Depanmenl of its obligations.

(S) TIle Min iste r may authorise Ihe payment o f prize money

Payment of prizes by the Depart men t shall be made by

(2) Payme nt of Division 2 and Division 3 pri~es maybe made

from authorized sellingpoinl$in cash or bychequedrawnon the agent's

name or Ihe name of other persons authorized by the Department .

11 . (\) The Director will publi~h the results of each game as

$OOn as possible aftcr each draw. The published results shall include:-

(a)

the numbers drown ;

(b) the amount of Pri~e Fund allocated to each Division; and

(c) the value of each prize in Division I, Division 2 and

Di vision 3.

(2) Slakers who consider they are ent itled to a Division I,

Division 2 or Division 3 pri ze and who do not , on application to a selling

point which is equipped with a terminal, obtain confi rm ation that the

ticket has won sueh a prize. shall personally lodge thei r claim to the

Director ..... ithin the claim period aooompanied by the staker's tieket.

(3) Prizes won on a win ning licket deposited at the

Department but for any reason left unclaimed afte r three calendar

mont h~ next succeeding the date of the relative draw will be fo rfeited.

(a) if the tiekel is not whole. or if it contains any alterations

or correction of the numbers registered Ihereon: or

Cb) if it does nOllally in all aspects with the reoordsslored in

the main computer

Provided lhat, where the winning licke t is not whole, the Minister may

in his discretion authorize the payment of the prize money if he is

sastisfied Ihal the pan produced conlains the necessary elements \0

establish the au thentici ty of the ticket or Iha1 the parts produced arc

pans of the same ticket and contain such elements.

(5) The Department's records 3S \0 payment of a prize in

respccl of a ticket shall be conclusive.

(6)

No prize shall bear interesT agairlSl the Department.

(7) The Director shall determine the da y and the lime up \0

which tic kets may be purchased al an agent's place o f business fo r any

particular draw . This in formalion will be prominently displayed al such

place of business.

(I) The Direclor may receive applications in such form as he "'"",""''''''"'

as an agent for the purpose of selling tickets in the game comlueted by

the Department.

(2) The Direetor shall consider sllch applications and may

accept or reject such applications without being liable to give any reason

(b) comply with sueh directi ons and requirements either

verbal o r in wriling issueu by the Dircctor in relation to the conducl

of the agent·s bllsiness, hours of work and days of business, and in

relation to the sale and retu rn of game ticke ts. o r the operation or

method of operation o f terminals inslalled in the agent"s selling

points, and the provision of such details or da ta aTKl returns of

info rmation and money requi red by the Depart ment from time to

time.

(1) A person who is appointed to act as an age nt may. Tc"""o/

agree ment from time to lime exist ing between the agen t and the

Department .

(2) The appoi ntment of an agen t sba ll be on such tenns as the

Di rector may from time 10 time in his absolu te discretion determine.

and such appointmen t shall be pcnonal to the age nt appointed and shall

not be capable of transfe r o r i1Mignment or ot her disposi tion withoullhe

prio r consent in writing o f the Director .

The Di rector . in respect of any ageDI whose SCT'Yiccs he

ma y terminate. may suspend such agent without terminating that

appointme nt for suet\ period or periods and upon such terms and

conditions as th e Di rector may determine .
