IN exercise o f the powers conferred by scction 304 of the Code of

Police Laws. the Mi niste r for Development of Teniary Sector with the

concurrence of the Minister of Finance , has m~de the following

regulations:-

These regulat ions may be cited as the Towage (Tariff of Rates)

Regulations, 1990. and shall come into force on the 21st November.

The charges for tug assistance to vessels entering. leaving or

shifting in the Grand Harbour. in Marsamxell Harbour or in

Marsaxlok k Harbour sha ll not exceed tile rates specified in tile Schedule

J. (1) The time for wllicll tile rates are applicable in accordance

whichever is tile earlier. and the lime of completion shall be thal when

(2) Subject 10 th e provisions of paragraph (1 ) of tllis

regulation. th e time to or from a ben h shall be calculaled , if the scrvice

is provided wi thin -

(a) Grand Harbour, at 20 minutes;

(b) Marsamxelt Harbour, at 30 minutes

(c) Marsaxlokk Harbour. if the tug or tugs are based at-

Ma rsax lokk Harbour, at 20 minutes,

(i)

(ii) Grand Harbour. at 60 minutes

Provided that for vessels with 50% and overtranshipment

cargo calling at Malta Freeport facilities at Marsaxlokk and for ves>cls

calling at Marsa xl okk for bun kering purposes only or in connection

wit l! oil blending and storage operat ions ror transhipment or re·export

purposes only, the time to and from a be rt h shall be calcl.ll;.led ;.s if

the service was being provided within G rand Harbour

Provided further th;.! the Director of Ports may. on

:.pplieatio n and at his discre1 ion. apply Ihe computations ,Uld conditions

of Ihe preceding proviso to any othe r vessel c:.lling at the Malta

Freeport.

The ordering o f lugs shall ta ke place .. s follows

(a) for movements to take place between 1600 hour.; of onc

day and 0800 hours ..,f the ne ~t following day , Ihe order shall be

made before 1200 hours;

(b) for movements to take placr: between OX4 ~) hou rs and

1600 hours or al :.ny time 011 Sat urd:.ys. Sundays and Public

Holidays, the order ,h~1I he made hc fore 17(~) hour.; of the

preceding day

(c) for movements to take place at Ma rsaxlo kk , the order

shall be placed at least three hours before the commencement of

the operation.

The Director ofPor!s may exempt from towage any ship in any Ex.mp';""

particular case.

(I) When normal rates are applicable under Column 2 of the c."""Uat"" a'

Schedule hereto. no charge shall be made if an order for the service of a <>r<I<rfor. ' ....

tug is cancelled and noticcof such canccllation is given at least two hours

before the time the service was due to commence.

(2) If the notice of cancellation is not given as provided in

paragraph (I) of this regulation , there shall be charged half Ihe hourly

rate specified in Column 2.

(3) Where a tug is ordered for service between 1600 hours of

one day and 0800 hours of the next following day and such order is

cancelled-

(i) if the order is cancelled between 0800 hours and

1600 hours and such cancellation is made not later than two

hours before the lime the service is due to commence. no

charge shall be made: provided that there shall be charged al

leasl the minimum rate of one hour as per Column 20r 30fthe

Schedule 10 these regulations. as applicable. including the

references to Note (1) thereof, if notice of cancellation is not

given as aforesaid;

(ii) if the order is cancelled between 1600 hours and

0800 hours of the next following day or at any time on

Saturdays, Sundays or Public Ho lidays there shall be charged

at least the minimum rate of onc hour as per Column 3 or

Column 4 of the Schedule to these regulations, as applicable.

including the references to Notes (I) and (2) thereof.

The Towage (Tariff of Rates) Regulations. 1980 are hereby

being repealed.

For services belween 1600 hours and 2100 hours lhere shall be

applicable either lhe charges computed at the rates under Column 3 or

tile charges computed altlle rales under Column 2 inc reased by Lm75

For services between 2100 Ilours of one day and 0&l0 Ilours of the next

following day or al any time 00 Saturdays, Sundays or olher Public

Holidays lhere shall be applicable eit her the charges computed at the

rates under Column 4 or the charges computed at lhe rates under

Column 2 illcreased by Lm 150 per tug, whichever is the greater.

Subject to the provisiolls of regulation 6 the mi ll im um charge shall ill no

case be less lhan lhe rate calcu lated for two hours.

(4)

The rates payable for the assistance of disabled vessels shall be

increased by fifty pe r cemum, subject to a minimum of Lm300 per tug

for vesSt:Js up to 3,000 gross registered tons and Lm500 per tug for

vessels exceeding 3,000 gross registe red lOll S.

"'Disabled vessels" means any craft which arrives off Malta on IOW or

with engi ne breakdowlI or with rudder trouble or other defeet which

effects the capabili ty of the vessel when manoueveri ng and includes any

tug assislance 10 such vessels ente ring, shifling or leaving lhe Maltese

Harbou rs.

Subject 10 lhe provisions of TCgulation 2. the rates payable for the

assistance of cruise passenger vessels calling al Malta with tourists and

for vessels calling at Malta for bunkering purposes only, shall be

reduced by twenty, five per centum, provided such vesse ls do not

discharge or load cargo or mail in a port or perform any commercial

operation. includi ng repJirs.

Subject to the provisions of regulation 2. the rates payahle for the

assistance of vessels wit h 50% and over transhipment cargo calling at

lhe Malta Freeport fJcil ities at Marsaxlokk and for vessles calling al

Marsaxlo kk for bun kering purposes .only or in connection with oil

blending and storage operations for transhipme nl or re-export purposes

only, shall be calculalcd al a min imum rate of onc hour or. if in excess of

one hour, the 3et ual time of operat ion to the nearest quarler of an hour;'

Provided further that lhe Director of Ports may. on application and at

his discretion apply the terms of the preceding proviso to any other

vessel calling althe Malta Freeporl.
