M"I"~ Vehicles Regulations (Amendment ) Order, 1990

IN exercise of the powers conferred by sectioo 28 of the Public

Tran,porl Authority Act. 1989. the Prime Minister has made the

followi ng order:-

I. This order may be cited as the Motor Vehicles Regulations a .. ' .....

(Amendment) Order, 1990, and the amendments affected thereby shall

be read and construed as onc with the Motor Vehicles Regulations.

1948, hereinafter referred to as "the principal regulations".

Immediately after regulation S of the principal regulations Add."" ...

there shall be added the following new regulation

The expression "Public Transport Authority" means

"SA.

the Publ ic Transport Authori ty established by section 3 of the

Public Transport Authority Act. 1989, and the expression

"Authority" shall, unless the context otherwise requires , have the

same meanmg.

The expression "public transport" means the conveyance in

Malta by a motor vehicle of passengers against compensation and

includes the hire of a self-drive car.

The expression "public transport vehicle" means any motor

vehicle used or intended to be used for public transport. "'.

(a) paragraph (1) thereof shall be renumbered as paragraph

(I)(a) and immediately after the words "Every motor vehicle in

these Islands" therein. there shall be added the words "other than

a public transport vehicle";

(b) immediately after paragraph (I)(a) th ereof there shall

be inserted the following new subparagraph

"(b) Every public transport vehicle shall be

registered with the Public Transport Authority in the manner

prescribed by the Authority,";

(c) in paragraph (2) . in suhparagraph (b) thereof. for the

words "or body." the re shall be substituted Ihc words "or body:~,

and immediately thereafter there shall be added the followi ng

proviso 10 the whole paragraph

" Provided that in the case of a newly imported public

transport vehicle or body of a public transport vehicle, the

owner or the importer thereof shall only be required ID

produce to th e Public Transport Auth ority such information

and documents as the Authority may direct."';

(d) in the proviso 10 subparagraph (a) of paragraph (4)

thereof, immediately after the words ~examination by the Police

possession of the vehicle and may re move it from the place where

it is kept to a place as may be designated by e ither of them. and

Immediately after paragraph (5) of regulation 19 of the

principal regulations there shaH be added the following new paragraph

"(6) In the case o f public transport veh icl es. all powers

and function s exercised by the Commissioner o f Police in virtue

of the preceding paragraphs of this regulation shall be exercised

solely by the Pub lic Transport Authori ty whiCh shall . for the sa id

purpose. be vested with all the powe rs a nd functions vested in the

Commissioner of Poli ce under this regul ation wi th regard to public

transport vehicles. ".

In regulation 19A of the principal regula tions for the words

from "Commissioner of Police," to "Commissioner." the re shall be

subst ituted the wo rds "Commissioner of Police or the Pub lic Transport

Authority, such details as to the ve hi cle or its engine as sh all be

con tained in a form supplied to him for the purpose by the sa id

Commissioner or by the said Authority.··.

For regulation 20 of the princi pal regula tions th ere shall be

subst itut ed the following

"20. The licellce fees for the various classes of motorveh.icles

are those fil<ed lmder Ihe provisiolls of the Police Licellces Act or

the Public Trallspon Authority Act , 1989.".

Regulation 22 of the principal regulation s shall be amended

as follows

(a) for the words "the Commissioner of Police may issue"

there shall be substituted the words "the Commissioner of Police

or the Public Transport Authority, as the case may be, may issue~;

sa id Commissioner" there shall be inserted the words ", or

Authority,'".

8, For the first and second paragraphs of reguiatioll 23 of th e

principal regulations there shall be substituted the following

"23. Licences granted under these regulations shall be liable

to be cancelled or suspended by the Commissioner of Police or

by the Public Transport Authority, as the case may be, for a period

not exceeding one month where this is required in the interest of

public safety or public order.

The provisions of th is regulation do not apply to cases

provided for in regulatioll \4 except that Ihe el<emption therein

provided shall simi larly be liable 10 ca ncellation or suspension by

the Commissioner of Police or, in the case of licences of public

transport vehicles, by the Public Transport Authority."'.

"Provided thll1 every person licensed under these regutll1ions

with regard to public transport ve hi cles shall also, when acting in

the capacity for which he is licensed, produce his licence on demand

or at an appointed place within two days of the date of such

demand to an officer of the Public Transport Authority. ".

In regulation 24A of the principal regulat ions. for the words

"Provided that the driver of a public tra nsport vehide shall

also produce the said Cert ificate of motor vehicle to an officer o f

Regulation 25 of the principal regulations sh all be amended

as follows

(a) in the proviso to Ihe ftflh paragraph thereof, for the .. ,.1";.,....

(b) in the sixth paragraph thereof, for the words

paragraphs of th is regulation shall. with regard 10 public

Auth ority which shall, for the said purpose, be vcsted with

all the powers and functio ns vested in the Commissione r of

Police under the said pardgraphsof this regu latio n with regard

to public transport vehicles.».

In regulation 26 of Ih e principal regulati ons for Ihe words

from ··of the Commissioner of Police. " 10 ··from this provision.·' there

shall be substituted the words "of the Public Transport Autho rity. In

special cases and in special circumstances. the Authority may. with the

approval of the Minister responsible for public transport. depart from

this provision. ".

Regulation 30 of the principal regulations shall be amended

as follows

(a) for th e first paragraph thereof. there shall be substituted

the following

··Every motor vehicle shall bear an identification number

which will be allotted to it by the Commissione r of Police or.

in the case of public transport vehicles. by the PublicTransport

Aut hority. provided tha t if the licence of any motor vehicle

is nOI renewed by the d ate fixed for its yearl y renewal, the

Commissioner of Police or the Public Transport Authority.

as the case may bc, may order the cancellation of such

identification number and its allocation to any other mOtor

vehicle."; and

(b) in the provi~ thereto. for Ihe words from ··Provided

that" 10 ·' pcnni(· there shall be substituted the words ··Provided

that the Com missioner of Police or. in the case of public transport

veh icles, the Puh lic Transport Authority may. in their discret ion.

permi!"".

In regulation JOA of the principal regulations, for the word s

from ··by the Commissioner of police 10 ··and word·· there shall be

subst ituted the wo rds '·by the Public Transport Authority, wh ich

number shall be preceded by the Letter ·'Y"; sueh number a nd lelter".

IS, Regulation 31 of the principal regulations shall be amended

as folloW);

(a) paragra ph (v) thereof shall be deleted, and paragraph

(va ) shall be rele ttered as paragraph (v);

(b) in paragraph (viii) thereof. for the words "by the Police

exami ners," there shall be substituted the words "by the Police

or Public Transport Authorit y examiners," and immediately after

the words "Commlssioner of Police" whe rever they occur chere

shall be added the words "or the Publi c Transport Autho rity, as

the case may be,"; and

(c) in the last paragraph thereof. imm ediate ly after the

word s "Traffic Con trol Board" the re shall be added the words

"or. in the case of public transport vehicles. by the Public Transport

Au thority".

For th e last two paraj!:raphs of regulation 32 of the principal

regulations there shall be substituted the followi ng

" No other letter, number or mark, except those authorised

by the Commiss ioner of Police o r by the Public Transport

Authority shall be permitted.

The Commissioner of Police with the advice o f the T raffic

Control Board or, in the c~se of public transport vehicles, the

Public Transport Authority, may permit, in writing , departures

from the requireme nts in respect of identification numbers and

number plates in cases where they are satisfied that such departures

are justified by the restricted space or the peculiarities which a

particular ve hi cle may have, in whiCh case the number plates and

the iden tification numbe rs sha ll be as directed in writing by the

Commissioner 01 Police o r by the Public Transport Authority as

the case may be.".

In regulation 36 of the principal regulations for the words

"shall be issued by the Commissioner of Police ." there shall be

substituted the words "shaH be issued by the Commissioner of Police

or by the Public Transport Authority. as the case may be,".

Regulation 37 of the principal regulations shall be amended

as follows

(a)

in paragraph (3) thereof-

(i) for the words" Commissioner of Police" wherever

they occur there shall be substituted the words " Pu blic

It shall, however. be lawful for the Public Transport Aut hority

ur the Commissioner of Po lice. as the case may be , at any time

wh en it is deemed necessary. to order the re·examination of these

motor vehicles. and for the Comm issioner of Police to order the

examination of any priv~te vehicle ....

Regulati on 97 A of the principal regulations shall be amended

as follows

(a) in paragraph (1) thereof. the word "Police" shall be

deleted; and

(b) in paragraph (3) th ereof. for the words "The

Commissioner of Police may, when it is so necessary for the

purpose of effect ing repairs or for any other good cause, authorisc"

there shall be SUbstituted the words "The Commissioner of Police

126. The drive r and conductor of a motor omnibus shall

wear an identification tag, prescribed by the Public T ransport

Authority, in a conspicuous place on the left side of their chest.

No dri~er or conductor of any motor omnibus shall ma ke use of

an identification tag other than that issued to him by the said

Authority. Such identificatio n tag shall not be transferable from

one driver or conductor to another.

Ticket inspectors and employees of the Central Offices for

Scheduled and Unscheduled Services shall also wear an

identification tag as may be prescribed by the said Authority in a

conspicuous place on the left sideoftheirehe~t. No ticket inspector

or employee of the said Authority shall mak e use of an

identification tag othe r than that issued to him by the said

Authority.

Identification tags shall be returned to the said Authority as

soon as the licence of the holder thereof expires o r is suspended." .

In regulation 127 of the principal regulations for the words

··the Police" there shall be substituted the words "the Public Transport

Authority".

In regulation 129 of the principal regulations. immediately

after the words "by th e Police or" there shaH be added the words Mby

Regulation 132 of the principal regulations shall be amended

the notice of the travelling public. The said notice shall remain

exh ibited for such period as Ihe Authority may direct.".

For the proviso to the first paragraph of regulation 151 of

the principal reiulations there shall be substituted the followin i

" Provided that ticket inspectors, Police office rs and anyofficcT

of the Public T ransport Authority may, in the execut ion of their

du ty, board any route bus at any point between one Bus Stop and

another. ··.

Regulation 152 of the principal regulat ions sha ll be amended

as foll ows

(a) in the second paragraph thereof, for the words "The

Police may o rder" there shall be substituted the words ~ An yoffiee r

(b) in the third paragraph thereof, for the words "by the

For regulation ]53 of the prin cipal regulmions there shall be

"153. No passenger not in possession of a ticket shall refuse

to pay his fare to the d river or conductor on de mand. The driver

or conductor shall deliver tickets corresponding to the fare paid

by the passenger e ither for himse lf or for any other passenger or

in respect of any parcel for the conveyance of which a charge may

be made under regulation ]47 of these regulations.

Drivers or conductors shall obtain the tickets from the Public

Transport Authority at '" price to be fi xed by th e said Authority.

The tickets shall show the fare charged and shall be of such

a size , colour and shape as the said Au thority may direct.

Eve ry driver or conductor shall have in his possessioll tickets

of all fares relative to the panicular route.

l ne driver or conductor of a motor omnibus sha ll be held

responsible for the complia nce of the prov isions of this

regulation. ~ .

[n the thi rd paragraph of regulation 156 of the principal

regulations for the words "of the Commissioner of Police" the re shall

be substituted the words "or the Public Tnmsport Authority".

In the second paragraph of regulatiOIl 157 of the princi pal A_~

when evidcnce is produced to the satisfaction ofthc said Authority

that the condition thereof is such that it can still ta ke the stresses

and strains cxpectcd to be transmitted to it by thc load of a motor

om ni bus body fully [aden, the weight of the number of passengers

for whom seating accommoda tion is provided, in addition to thc

weight of the drive r, condu ctor, ticket inspector, and any

authoriscd number of standing passenge rs, being calculated at 72

kg, per person

Provided further that the said Authori ty shall not allow the

use of any motor omnibus chassis unless the examiners of the

Authority are satisfied as to its fitness and suitability; and th e

Authority may. besides imposing such o ther conditions as it may

deem fit. requirc a certificatc as to the structural efficie ncy of the

chassis from an expert having such qualifications as the said
