IN exercise of the powers COTIfe rred by section 28 of the Public

Transport Authority Act, 1989, lhe Prime Minister has made the

following orde r: -

I. This o rde r may be cited as the T raffic Regu lation O rdinance

(A mendment) Order. 1990. and the amendments affected thereby shall

be read and construed as one wilh the T raffIC Regulalion Ordinance. cap.M.

Section 2 of the principal law shall be ame nded as follows

(a) immediately before the definit ion of "ferry·hoae there principal Ia",_

shall be inserted the following definition

"the words "Authority" and " Puhlic Transport

Authority" mean the Public T ransport Authority estab lished

by section 3 of the Public Tra nsport Authority Act. 1989;"; A<:I No . IX

(b) immediately after the definition of "owner" there Shall

be inserted the following definit ions

kthe words Mpublic transporl" have the same meaning

given to them by sectio n 2 of the Public Transport Authori ty

tbe words Mpublic transport vehicle" have the same

meaning given to them by section 2 of the Public Transport

Authority Act. 1989.".

SUbsection (I) of section 3 shall be amended 11$ follows

(a) for the words Min any such o rde r." there shall be

substituted the words "in any such o rde r:": and

(b) immediately at the end of the subsectio n there shall be

inse rted the following proviso:-

" Provided that in the ease of pub lie transport ve hicles, the

powe r to make orders shall be e xclusively exercised by the

Public Transport Authority ....

of. [n SUbsection (I) of sect ion 4 of the principal law. for the words

the words "and to the transport of goods".

S. For subsection (I) of section 5 the re shall be substituted the

followins:-

'·(1 ) The Publie Transpon Authority may from time to time.

passenge r tran sport service, do all or any of the following

(a) establi sh routes for the conveyance of passcngcf'j

from one part of Malta to another, o r from one isla nd to

anothe r;

(c) dete rmin e which mot or buses shall o perate on any

such rout e;

(d) allot the service on any such route to any company

or companies and. o r to any individual person o r persons;

(e) vary , cancel o r revoke any such rou te or any

groupi ng of routes o r any allotment of service thereon,

and may do so upon such conditions as the Authori ty may d irect ;

and in making any all otmem of service under this section the

Authorit y may ma ke such allotment to the exclusion o f any other

company or companics o r any other individual person or persons.'· .

Section 6 of the principal law shall be amended as follows

(a) for the words ··by the Commissioner of Police" there

In section 7 of the principal law for the words - discretion of the

Commissioner of Police, on the advice of the Board. under- there shall

be substi tuted the words -discre tion o f the Public T ransport Authorit y

Imm ediate ly after subsection (2) of section 8 of the principal

law. there sha ll be added the followi ng new subsect ion :-

-(3) Saving the provisions of subsection (I) of thi s sect ion.

the Publ ic Transport Authorit y may appoint its e mployees as traffi c

inspectors. hereinaft cr in this Ordinance also referred 10 as

·'inspectors··, so u to ensure the due observance of the laws and

regula tions rela ting 10 public tTllnspon . and the employees who are

so appointed shall have the funct ions and dut ies such as are or may

be assigned to them by the Public Transpon Au thority.··.

In paragraph (b) o f su bsection ( I) of section 15 for the words

-a llotted by the Police; or- there shall be substituted the words "allotted .. "'.,., 15

by the Police or by the Public Transport Authority; o r" .

Section 160fthe principal law shall be amended as (01101'1'$:-

(a) in subsection (I) the reof, for the words - from the

Sectio n 17 of the principal law sha ll be ame nded as f0I10W5:-

(a) for subsectio n (1) thereof the re shall be substitu ted the

following

"(1 ) (a) Subject to the provisions o f paragraph (b) of

this subsection. it shall be lawful for the Commissioner o f

Police wi th the advice of th e Board to make regulations in

respe ct of road traffic and the n a!lsport of goods whelher by

land or by sea in the isJands of Malta and Oow or between one

island and the othe r,

(b) 11 shall be lawful for the Public Transport Autnority

to make regulations in respect of public transport, H: and

(b)

subsection (2) the reof shall be amended as folloW$

(I) for the words Hof the aforesaid power," there shall

be substituted the words ~of the aforesaid powers,H;

(ii) in the Maltese lex, of paragraph (b) the reof, for the

(iii) in paragraph (d) thereof, for the words -by the

(iv) in paragraph (t) thereof, for the words - to the

Commissioner of Police:" there shall be substituted the words

"to the Public Transport Authority:",

IS, Subsection (5) of section 18 of the pri ncipal law shall be

amended as follows

(a) in paragraph (a), in subparagrap h (i) of the proviso

thereto, for the words "by the Commissioner of Police H there shall

be substituted the words "by the Public Transport AuthorityH;

(b) in paragraph ( b), in subparagraph (i) thereof, for the

words "to the Commissioner of Police- there shall be substituted

the words "to the Public T ransport Authority"; and

(c) in paragraph (b), in subparagraph (ii) the reof, for the

words "to the Commissioner of Police," there shall be substituted

In the interpretation o f this order, regard shall also be had to
