Regulations, 1\l9(\

IN exercise of Ihe powers conferred by section 16 o f the HOlels

and Catering Establ ishments Act, the Minister for Development of

Tertiary Sector has made the following regulations:-

( I) These regulations may be ci led as Ihe Hotels and

Catering Establishments (Am endment ) ( No. 3) Regulations. 1990 and

shall be read and construed as one with the Hotels and eatering

Establi!>h me nts Regulations, 1972. hereinafter referred to as Mthe

principal regu latjon5~.

(2) These regulations shall be deemed to have come into

force on the IsIJa nuary, 1990.

The Second Part of the Second Schedule to the pri ncipal

regulations shall be ame nded as fo llows

(a) in Section MB" thereof, in MIV Fourth Oass~, for the

paragraph titles wC. Facililajiel in the Maltese text thereof and

"D . General RequiremcntJ" in the English text the reof, there shall

be substituted the titl es "C . IlTiticl Ct'neraU" and "C, General

Requiremen/J" respect ively; and

(b) im mediately at the end of Section wC" thereof, there

sh all be added the followin g

f1RST CLASS

(i) Th e pari providing hotel rooms shall mee t the

requirements of a Fou r SUIT Hotel as laid down in paragraphs

(C) Bedrooms, (D) Sanirary Equipment, (F) Corridors or

PIIssagcs. (G) Kitchen and ( H) Service in Section ' B' of the

Fin>1 Part of th e Second Sehedule to these regulations.

<ii ) The pan providing self.·contained furnished units

for accommodat ion shall meet the requirements of a Fi rst

Class Holiday Co mplex. Tourist Village or Similar

Accommodat ion as laid down in paragraphs (A ) Apa rr~nlS,

(C) Amenities and ( D) Gtntral Rtquirtmtn/J in " I firM Q ass w

of Section M B ~ of the Second PHn of the Second Schedule to

these regulations.

(iii) In those cases whe re, as a rcsult of the requir.!me nts

of paragraphS (i) and (ii) of this Oass, duplication

requirements result, it is to be taken that no duplication is

required and those at paragraph (ii) shall prevail.

SECOND CI.ASS

Ci) The pan providing hOlel rooms shall meet the

requirements of 0 Three Slar HOlel as laid down in paragr,lphs

(C) Bedrooms. (D) Sunitary Equipment, (F) Corridors or

Plll5agB, (0) Kitchen and (H) Service in Section 'C' of the

Fil"5i Part of the Second Schedule 10 these regulat ions.

(ii) The pan providing self-contained furnished units

for accommodation shall 111«1 the requirements of a Second

Class Holiday Complu. T ourist Village or Similar

Accommodation as laid down in paragraphs ( A) ApD""ll'nLJ,

(C) Amenities and (D) Genua/ Requirements in ~ I1 Second

Class" of Section " 8 " o f the Second Part of the Seoond

Schedule 10 these regulations.

(iii) In those cases where, asa result of the requirements

of paragraphs (i) and (ii) o f this Class, duplication

requirements resutl. it is \0 be laken Ihal no dupl ication is

required and those at paragraph (ii) shall prevail.

III

THIRD C LASS

(i) The pan providing hotel rooms shall meet the

requiremenlll of a Two Star HOIel as laid down in pa ragraphs

(C) Bedrwms, (D) SUl1i/(Jry £quipmel1l, (t) Corridors or

PassugeJ, (G) Kitchen and (H) Service in Section '0' of the

First Part o f the Seco nd Schedule to these regulations.

(ii) The pari providing self-contained furnished un its

for accommodation shall meet the require menlll of a Third

Oass Holiday Complex, Tourist Village or Simila r

Accommodatioo as laid down in paragraphs (A) ApDrlmenl.J,

(C) Ameniliu and (D) General Requiremenl.J in MU! Third

Class~ of Section " B ~ of the Second Pan of the Second

Schedule to these regulations.

(iii) In those cases where, asa res ult of the requirements

of paragraphs (i) and (ii) of this Class. dupli cation

requirements result , it is to be taken that no dupl ication is

required and those at paragraph ( ii) shall prevai l.

fOURTH Cl-ASS

Ci) The part pro,·iding hOlel rooms shall meet the

requirements of a Qne Star Hotel as laid down in paragraphs

(C) Bed,wms, (D) Sani/(Jry Equipment, (F) Corridors or

Passages, (G) Kitchen and ( H) Sen'ice in Section ' E ' of the

Fi rst Part of the Second Schedule 10 these regula tions.

(ii ) The pan providing self·cont ained furnish ed units

for accommodation shall meet the requi re ments of a Fourth

aass Holiday Complex. Tourist Village or Similar
