CONDITIONS OF EMPLOYMENT (REGULATION) ACT

IN exercise of the powers oonferred by 5ection 8 of the Conditions

ofEmploymenl (Regulation) Act , the Minister for Social Policy, having

received proposals from the Seamen Wages Council conce rn ing the

conditions of e mploymen t o f the e mployees in relation to whom the said

Wages Counci l operates, has made the following order:-

I. (I) Th is order may be ci ted as the Seamen Wage5 Council a..;,.~

Wage Regulation (Amendment) Order. 1990 and shall be read and

oonslrued as one with the Seamen Wages Council Wage Regulation LS. l00

This order shall come into force on the 23rd July, 1990.

Immediately afler the definition of "whole·time employee" in A_~

which wbole-time employees may be entitled under para-

graph 9 . whole-time employees shall be entitled to the

Nationa l Holidays and to all public bolidays with full pay. and

to the following vacation leave not being less Ihan -

(a ) four working .... eeu and one working day

during the ca le ndar years 1988 and 1989

(b) four working weeks and two working days

during the calendar year. 1990;

(c) four working wee ks and three work ing days

during the calendar year, 1991;

(d) four working wee ks and fou r working days

du ring the calendar ye ar 1992 and during any calendar

year thereafte r

Provided that when a whole-time employee is in

e mployment for less than twelve months during any calendar

year. he shall be ent itled to such part of the said vacation leave

as is in proportion to the nwnber of months in employment,

(2) For the purpose o f this paragraph " vacation

leave" means leave with pay which may be avai led of on days

agreed upon between the employer and the employee, pro-

vide<! that onc day vacation leave during 1988 and 1989. two

days vacation leave during 1990. three days vacation leave

during 1991 and four da)" vacation leave during ]992 and

during any calendar year thereafter shall not form part of any

shul(lown and shall be granted by the employer as optional

leave in addition to any optional leave the employee may have

bt!en entitled 10 o n the 9th November, 1988.".

Paragraph 6 of the Schedule 10 the principal order shan be

amended as follows:-

(a) in sub-paragraph (8) thereof, for the words "National

Insurance Act . 19S6" lherc shall be substitu ted the words "Social

Security Act. 1987": and

(b) in sub-paragraph (b) Ihereuf. for the words "National

Insurance Act. \956" there shall be substituted the words "Social

Security Act, 1987".

For paragraph I 1 of the Schedule to the principal order there

shall be substituted the following new paragraph:-

(a) A who1e-timeemployee shall beallowed three

days leave on full pay on the occasion of his marriage , and two

days leave on full pay on the birth of a child to his wife.

(b) A whole-time employee sh all be entitled to up

to tcn (10) days study leave in anyone year on full pay to

obtain a certificate in his trade

Provided that study leave will be approved subject

to the produetion of the necessary infonnation about the

certificate in question by the employee and Ihat he will be

bound 10 work for at least three months with the company

a fle r the results are published. Such slud~ leave is not 10 be

avwed of more than twice for the same certificate;

Provided furthe r that if the employee opts to ter-

minate his emp loyment before three months have etapsed.

the e mployee is bound to pay to his employer the sum of

money equal 10 the wages that have been paid to him in

respect of the number of days availed of all study leave .".
