IN exercise o f tile powers conferred by section 5 o f the PubLic Lono

Ordinal1Qe, the Minister of Fina nce has made the following

regulations:-

I. ( I) These regulations may be cited as the Pu blic Lotto

Regulations . 1990,

(2) "These regulations shal l come inlo force on the 23 rd J uly.

1990 and shall apply with regard to the lotto draw of the 28th July , 1990

and \0 subscc;uent drtlW1 in all areas and lotto offices of Malla and Gozo.

In lliesc regulations unless the context mherwisc requires:-

means the sales made by that lotio o ffice between the first draw in

J anu ary and the last draw in December of the same year;

"claim period" means the period following a draw wit hin

whieh the sta ker in posses.sion of I winning ticke t may claim a priu;

~conceS5ionary" means a band club or othe r society to which a

10110 office is assigned in accordance with the provisions o f

regulation 9 of these regulat ions;

"Department ~ means the Department of Pu blic Lotto;

" Director" means the Director of Public lotio and to the

exte nt of the a uthori ty given . includes any officer of the

Department authorized by the Director in th at beh alf for any

purpose of th ese regulations;

~draw ~ mean s the extraction at random by physical,

mechanical o r elect ronic means o f five numbers from o ne (I ) to

ninety (90);

"lotto office" means any office o r any b ranch o r section o f the

Department or the place of business of a lotio receive r at wllich

autllorized sales can be made;

~Iolto receive r" means t he person appoint ed by the Minister tet

acce pt and va lidate stakC'5 on beha lf of the stake r for tile purpose Gf

~ main computer" means the computer syste m si tuated at the

Departme nt or the localities as indicat ed by the Director. and on

which all information with regard to tickeu; panicipating in a draw

is read and stored and may be retrieved for funher processi ng of the

draw;

"Minister" means the Minister responsible for finance and

includes, to the eln ent of the authority give n , any person

authorized by the Minister in that behalf for any purpose of these

regulations;

~staker~ means the person in possession of a valid ticket issued

through a terminal ;

"te rminal~ means the data captu re machine si tuated at a lotio

office from which aut horized sales can be made

"ticket" means the tick et printed by a terminal and bearing the

following information

(a)

an identifyingdrawnumberforadraw in I panicular

(b) the machine number andlor the lotto reeeive r

number of the relevant lotio office termin al;

the ticket regiSI!,~tioD number;

(c)

(d)

the stake paid : and

(c)

the numbers selected by the staker.

( I ) The d rawing of the numbers shall be held publicly allhe

office of the Director or al such ol he r place as may from time 10 time be

appointed for the purpose by the Minister . in the prc.sence of: -

(a) a representative of the Director

(b) a reprcscnLative oftbe Acrountant Gene ral;

(c) a representative of the Director of Audit ; and -

(d) a nolary public.

( 2) The notary public prcsent I t the drawing of the numbers

shall draw up and sign a record of the proceedings which shall beente rcd

in a regiSle r to be Ice!>, for the purpose.

(3) The drawing of the numbers shall be held on each

Saturday aI , or as soon as possible after, one o'clock in Ihe afternoon

Provided Ihat if a public holiday falls on a Satu rday. the drawing of the

numbers shall be held on the prtcceding Friday. and , if Ihe precteding

Friday is also a public holiday, il shall be held on the Monday following.

(4) The Director will publish the numbers drawn in each

game as soon as possible afte r each draw.

(1) It shall be lawful to lay stak es for the drawing of:-

the first number

two numbers (ambo)

three numbers (terno)

four numbers (qu3temo),

but the placing of stakes on more than onc combina tion of num bers o n

the same ticket. except o n such as may be expressly provided for the

purpose, 5hall not be permitted.

Lotto tickets shall be of the following valucs:-

combi nat ion is expressly allowed.

(3) Receipt of the ticket by a staker shall constitute an

acbJowledgcmen t that the numben lhcreon are the player's

selection. It is the responsibility of the sta ker to ensure that th e

numbcn shown on the ticket are correct before leaving Ihe 10110

office.

(4) Aplayer panicipates in the draw when the relevant

information about his stake is deposited at th e Depanment of lollo

receive r in the presence of the Director in the case of Malla and in

the presence of the Commissioner or his representative in the case

of GOla. If, for any reason whatsoeve r, such information is not

rece Ived and entered in the mai n co mputer at the Department

the related stakes are au tomatically invalidated and the staker 'is

en titled only to a refund equivalent 10 the amount staked upon

presentation of the relevant ticket.

(5) The tickel5 in the d raw shalt o nly be those stored in

the main computer at the Department .

(6) A tick et has been recorded as void on the dat a

capturing media oftbe main computer shall be deemed to be void

an d of no validity in claiming a prize, and the staker shalt no claim

against the Department o r the lotto receiver whether such void

recording is auributed to the staker, to a malfunction of the

compu~er system o r to an e rroe on the part of the opera tor or lotto

receIVe r.

Lotto prizes shalt be of the following amounl5:-

on the first number drawn

sisty-four times the amount of the stak e;

on two numbers drawn

two hu ndred and fifty times tbe amount of the slake;

on th ree num bers drawn

two thousand times the amount of the stake;

on fOUT numbers drawn

five thousa nd times the amount of the stake.

Ihe Slat e of a particular draw , whichever is Ihe less, the amount of each

pri~e shall be reduced proportionately so that the 10lal value of the prize

shall DOl e xceed that limit

Provided that the amount o f l.ml80,lXXJ or the 101a[ value of the stakes

for a particular draw, as the case may be, may be exceeded by not morc

than 20% if the minister is satisfied that such excess is justified on th e

grounds that reduction in payment of prim, were i, not fort his proviw,

would be minimal and that administrative requ irements would waTTant

such excess.

(2) In computing any such proportionate reduction. any

fraction of acen\ not exceeding five mils forming part o f a reduced prUe

be Ignored. and any fraction o f a ce nt exceeding five mils forming part of

a reduccd pmc shall be a)nstrued acoordingly.

Noticc of all winnings shall be given to the Director within NcIificatiOllol

thirty days from the date of the respective drawing.

(1) Wi nning ticke ts shall be presented for payment and I'rIzcWdno.

exa mination within thirty days from the dale of the respective draw

Provided that if the last day falls on a Sunday or pu blic holiday,

the claim period shall be utended to the fint following working day.

(2) Payment o f prizes by the Department shall be made by

cheque or as the Directo r ",ay direct from time to time .

(3) No prize mo ney shall be paid unless the relevant winning

ticket is presented.

(4) Un!essOlherwise instructed by the Minister or by the per·

son prese nting a winning ticket , the prize mo ney shall be paid to who-

eve r prese nts the winning ticket. The payment o f any prize won by a

staker o n such a ticket shall bcdee mcdas a full di scharge by the Depart·

ment of all its obligations.

(5) The holder of a winning ticket shall not be entit led to th e

prize: money -

(a ) if the ticket is not whole , o r if it a)n tains any alterations

or corrections of the numbcn registered thereon; or

( b) if the ticket does not tally in all aspects with the records

stored in the main computer

that . where the winn ing licket is oot whole. the

M.inister may in his discre tion aut horize the pa yment of the prize money

if he is satisfied that th e part produced co ntain s the necessary elements

to establish th e authent icity of the ticket or that the parts produced are

parts o f the same ticke t and contai n such ele men ts.

(6) The records of the Depart men t as 10 payment of a prize

in resp'cct of a tic ke t sha ll be concl usive.

No prize shall bear inlcJ"e$\ againsllhe Depalmenl.

(8) The Minister may aut horise the payment of prize money

to the winners after the claim period expi res if in his absolutcdiscretion

he considers Ihal circumstaDCe$ justify such a payment.

(1) LoIIO offi ces shall be di vided into IWO s.ection, 10 be desig-

nated as the ~ Independent SectionM comprising the lotio offices "'" by

receivers on their own account , and the MOcpendent Section H compris-

ing Ih e lotio offices aSliigncd 10 band clubs and ol her societies.

(2) The Minister shall have the po .... e r from time 10 time 10

decrease or increase Ihe number of such o ffices, and 10 trander any of

them from onc locality 10 another.

(2) In the Dependent Section, rent and electricity consump-

tion and mete r rent shall be borne in thcirentirety by the concessionary

when the lotio office is housed in the same premises as the club or soci-

ety to which it is ~igned , and shall be borne as to one-half by the con-

cessionary and as to the other half by the lotio receiver when the lotto

office is housed elsewhere_

(4) Any agreement between the concessionary a nd the lotto

receive r regarding the payment of expenses which is not in conformity

with the provisions of subparagraph (a) o f this parpgraph shall be null

and void.

Lotto Receivers shall be appointed by the Minister and they

shall give such security required as is in relative proportion to the

pmount of business carried on in their respective offices as the Minister

may in his discretion detennine.

11 . ( I) From the total amount of sales made in respect of each

game ten pe r cenlum (10%) of such amount shall be pllocated for any

commissions due to lotto receivers and concessionaries and for subsidies

that may be allocated fo r sponing activiticsor any such activities as the

Minister may delennine ' rom time to lime.

(2) The Minister may from lime to lime determine different

comm ission rates payable 10 lotto receivers in the Independent and De·

pe nden t Sections and when applicable to collttSSionaries of lotio off'1CeS

in respect of sales. The Min ister may also from lime 10 lime determine

the commission rates payable 10 all lotto receivers in respect of C<i5hing of

wi nning tickets.

(3)

In the Dependent Section of lotto offices-

(a) wages paid toassistanlS shall be borne as to two-fifths by

the concessionary Hnd as to three-fifths by the 10110 receivers; and

( b) any agreement between the concessionary and the 10110

receiver regarding the paymcm of expenses which is oot in confor-

mity with Ihe provisions o f sub-paragraph (a ) of this paragraph

shall be nu ll and voi d.

(4) Reccivcrs shall be bound to ca rry on the busin ess perso n-

ally with the help of assistan lS wh ere necessa ry .

(5) It shall not be lawful for lotto rece ivers to en ter into or

continue in any partnership in connect ion with tbeir lotto office, o r to

have any direct o r indirect inlere$t in any 10110 office o lher Ihan the o f-

fice assigned to them. nor shall tlley be a llowed, witlK>ut the conse nt in

writing of Ihe Director. to e ngage d irect ly or indirectly in any business

o r to follow any occupatio n other Ihan that connected wilh their Iotloo!-

fiee.

Nothing contained in Ihese regulations or any othe r law. shall

be construed as impl ying tha t Ihe 10110 receiver is an agent o f the De- 11._ '

such purposes the lotio receiver shall be deemed to be exclusively the

agent of the stake r.

(I) These regulalionsandconditions shllll apply and shall be

binding on all staken as soon as payment of the relative slake is made.

IS. (1) Without prej udice to the provisio ns of paragraph (2) o f

thi s regulation. the lotio Regulations. 1948, are he reby repealed.

(2) Notwithstand ing the provisions of paragraph ( I) of this

regulation. Ihe Lotto Regulations, 1948 shall oontinue 10 operate with

respect to the 10110 draw of the 21st J uly. 1990 and to preceding 10110

draws. and the reafte r, as from the 23rd J uly. 1990 and with respect 10

the lotto draw of the 28ttl J uly , 1990 aod 10 subsequent lotIo draws, as

applicable in such areas and lotto offices in Malt a and G ozo whe re the re

occun a failu re in the elect ric power supply, or a mechanical fault in the

main compu ter or in Ih e lenninal of a 10110 receive r, or in such inslaooes

as the Ministe r may from time 10 ri me de tennine as necessary for the

smooth running of the game.
