Drugs (Control) (A mtndmentj Regu llltlon5, 1989

IN CJ[ercise of the powers conferred by se<:tion 40A o f the Medical

and Kindred Professions Ord inance , the Ministu for Social Policy, on

the advice of the Cou ncil of Heal th, has made the following regula-

These regulatio ns may be cited as th e Drugs (Control) Citation .

(Amend men t) Regulations, 1989, and shall be read and construed as

one with Ihe Drugs (Control) Regula tions, 1985, hereinafterreferred to L.N.22

as ~the principal regulations".

Regulation RA of the princi pal regulations shall he amended as

(a) for paragraphs (I) and (2) thereof there shall be substi-

tuted the fol1owing:-

~(l) Without prejudice to the provisions o f regulation 7

of these regu lations,

(I> no medica l practitioner may prescribe any

specified drug to any person unless such person is in pas-

regu[atioll$, issued for the purpose by the Superintendent

of Public Health;

(b) in prescribing any specified drug 10 any person,

the prescriber sball enter in a clear. indelible and legible

manner allthedetail$ set out in columns I to 4 0 fthe Con-

trol Card, lInd shall then return the ca rd 10 such person to-

gether with the prescription

Provided that a med ical practitione r may , in making the

application on behalf oh person on the request form asset out

in the Tenth Schedule to these regulatioll$, also issue a pre-

!iCl"iplio n for a supply of a specified drug to such person and

may attach the prescription to such request form

Provided further that such prescription sllall on ly become

valid wllen tile provisions o f the proviso to pa rigraph (2) of

tllis regulation have been complied with.

(2) The Superintendent shall issue such Cont rol Card to

the peBOn concerned on re~eipt of a request, Crom a medi cal

practitioner to tllis eCfecl , made o n th e form 85 set out in tile

TClllh Scll edule to tbese regulations

Provided Iha ' in the case of a prescription for a supply of a

spe6fied drug as provided for in the provisos to paragnaph (1) o f

this regulation, the Superintendent shall enter the details o f tb e

relative prescription in columns 1 to 4 of the Control Card.~

(b) in paragraph (6) Ci ) (2) thereof, for th e word s "does

not exceed three days supply" there shall be substituted the

words "does not exceed seven days supply"; and

(c) immediately afte r paragraph (9) thereof tbere sball

be inserted the followin g new paragraphs

"(10) TIle Superintenden t may wit hdraw the Control

Card of a person who is SU!ipecled to be abusing a drug pTe-

JCribed 10 him , or who is in any o ther way abU5ing the Control

Card system .

(11) The Superintendent may include on the Control

Card such guidelines as he may deem necessary regarding the

prescript ion o f specified drugs.",

In tbe Ninth Schedule to tbe principal regu lations, after the

words "Signature of Medical Practitioner" in the fourth column to be

mled by the Prt$Cri ber, there sha ll be inserted the wo rds ~and Medical
