Mcrchant Shipping Act, 1973, thc MinisteT fOT Oevelopncc ntofTcrtiary

followin!, regulotions:-

I. These regulations may be ci led as tile Mercllanl Slli pping

(Sub!ililulion of Firsl Schedule) Regulations, 1989, a nd shaU be read

and construed asone witlltlle Mercllant Sllipping Act, 1973, hereillafter

rderred to as ~tlle principal Ac' '',

For tile First Schedule 10 the principal Act, Ihe re shall be

(2) The mlmmum fee on first registration and the mi nimu m

an nual fce shall be equal to the fee respef.1ivciy due on one hundred

tons.

(3) The an nual fee due in respect of anyone yea r (othe r than the

year o f fi rst regisl ration) shall be increased in a=rdance wilh the scale

listed Mreunder for each member of the crew who was not a cit itt n o f

Mal ta in respect of each period o f, or each aggregate of pe riods

amounti ng to. thirty days during which such member of the crew was

engaged on the ship in the yea r immediat ely preceding the year in

respect of which the fee is due

C. The fee o n first registra tion and the annual fee in respect of any

ship shall be rounded upwards 10 the nearc51 wholc lira .

D. The: Minister may , in special circumstances, and under such

C(lnd itions as he may deem appropriate. exempt any sllip or any

'lass of ships {rom the payme m of all o r part of the {ees payab le in

te rms o f these regulations.

E. For the purposes of this Schedule,

" fishing boat" shall have the meaning assigned to it in

section 206(7) of the Merchant Shipping A ct. 1973: aod

- ton-means a unit o f net or register tonnage. and the net or

register mnnage of a ship having alternative net or reg,ister tonnage

shall be taken tQ be the la~r ton nage." .
