of Disca!;e Ordinan~"e. the Min ister of Productive D"velopment, o n the

advice of Ihe Council of Health , has made Ihe following regu lations:-

In these regulatio ns. unle$S the oontext ot herwise req uires

" Di rector" means Ihe Director of Agricultu re and Fisheries

and includes a ny officcr of the department duly authorised by Ihe

direct or to act o n his behalf

J . (I) Fo r the purposes o f ensuring Ihe prevention of spread of

disease amongst an imals, the Director shall keep a registerof farms and

of a ny person who works thereat.

(2) I1 shall be the du ly o f every person who keeps a farm, or

who works or is e mployed thc real. to register himsel f and the farm he

wo rks 3t , or keeps. with the Director. and no person shall keep animalS

in, or work on. such fa rm unleliS he and lile fa rm he works on are 50

registered.

Every applicalion for the regist ratio n o f a farm sha ll be made Silo.pIan

by the keeper of such farm . and $hall be accompan ied by a si te-plan

showing the place: and its surrounding area within a distnnce of tWQ

hundred metres from the perimeter of the farm.

No perloOn shall move or cau~ any animal to be moved from a

registered farm to any other place or to an abanoi r. un leM he has

previously obtained permission in writing from the Director to that

effect.

Every keepe r of a farmshall kc:cpa Farm Book. in such form as

the Director shall require, in which shall be entered detailS of the

number and type of animals being kept in the farm and any addition or

reduction in their numbers. as well as any details of identification,

together with the relative dates.

(I) No person registered as afo resaid in these regulations,

shall aequire an ima ls. for any purpose. from any person who is not

registered under regulation 3 of these regulations.

(2) Any animal on a farm registered in a<xordllnCe with

regulation 7 above shall be identified hy tattooing. or by

freezebr~ nding. or by ear tagging. or by any other method to the

satisfaction of the Director.

(I) Any person who keeps bovines shall register all relative

births with the Director with in ten days of birth .

(2) Any person who keeps ovines or capri nes shall register

all animals that arc being kept fo r breedi ng within three monthsoftheir

birth.

10. Immediately the dealh of a registered animal occu rs. the

dealh shall either be reported to the Director, or the animal shall be

certified as dead by 3 regi stered veterinary surgeon.

11 . (I) No person may carry out artificial insemi nation in

animals unl ess th e Director is satisfi ed that such person is qualified to

carry ou t such insemina tion and is registe red by the Director for tha t

purpose.

(2) For the purposes of this regulation. a person shall be

deemed to be q ualified if he passes an oral and practical test in the

subject to the satisfaction of the Director.

(I) For the purposes of prevention of spread of disease. the

Director may

(a) by notice in the G azelle limit or prohibit the sate or

movement of animals, to or from any part of the~ isla nds

(b) require any pcrson registered as afores;lid in Ihe$C

regulations to give all information concerning the m~·.:ments of

an imals to or from his farm. and all relative »11'5 and purchases;

(c) at any rcasonable time enler any sh<."d or ot her place

where he has reasonable groumls for supposing Ihat animals are

kepi. for the purpose of:-

(i)

inspecting the animals kept the rei n; or

(i i) subjecting the anim als to any tests necessary for the

di agnosis of d isease; or

(iii) ta kin g samples of blood or other material from

anima ls for the purposes of d iagnosis of d isease ; or

(iv)

marking of anima ls in such a way as he considers

e ~pedient

for th e purpose of their identification. or H$

provided under par;'gmph (2) of regulat ion 8 of these

regulation s; or

vaccinating the anima ls.

(v)

(2) It sha ll be the duty of a ny person registe red as aforesaid

in these regulations to provide all necessary assislance 10 the DireclOr

for the prope r di scha rge of hi s fun ctions unde r paragraph (I) of this

regulation.

Where. afte r sueh investigation as he considers necessa ry, the

Director is satisfied that a farm is free from di sease. he may issue a

certificate to t he keeper o f suc h farm to that effect and, thereafter. such

kecpe r shall not introduce in to the form a ny ot her ani mal which is nOI

certified by a Govemfficn t Vele rinary Surgeon to be free from discasc.

( I) Where in the opinion of the Director all fa rms in any 0 .. ",,_.

area in Malta and Go~o have ~n ce rt ified by him to be free from

disease in accorda nce with the provisions of regul ation J3 of these

rcgulations. the Director may issuc a notice to that effect in the Gazclle.

(2) Where slICh not ice has bee n issued. no person shall

introduce into such area any animal unless such animal is ce rtified by a

Government Ve te ri nary Surgeon to be free from disease.

Any person who cont rave nes or fails tocomply with anyofthc

provisions o f these regulations. or with any direction given the reu nder,

or who hinders o r ob$t rllCt~ the Dire<:tor from doi ng anything that he

may lawfu lly do under the provisionsof thesc regulations. shall be guilly

of an offe nce againsl Pari 11 of the Prevention o f Disease Ordinance,

and the provisions of Title III of Pan III o f the said Ordinance shall

apply.

Without prejudice to anythi ng which may have been done

under their provisions. the following regulations arc hereby revolted:-
