IN exercise of the powers conferred by section 16 o f the Food.

Drugs and Drink ing Wall:r Act. 19n, the Min ister fo r Social Policy, on

the advice o f Ihe Council of Hea lth . has made the following

regulatioIlS:-

These reglJ l ~tions may be cited as Ihe Bakeries (Use of Fuel)

Regulations, 1989.

In these regula tions, unless the oonteKl ot hcl"'ise requires.

"bake ryM includes a bakehouse or any simi lar establishment by

whateve r name ca lled .

treatment i o any bakery-

(a) use any fue l othcr Ihan lead-free fue l suppl ied by the

Encmalla Corpora tion or by any other approved ~gent for such

purposes; o r

(b) use any such fue l as referred to in paragraph (a) above

afte r it had al ready bee n used for an y purpose OIhe r than oooki ng

or baking o r heat treatment in any bakery : o r

le)

use any woode n material contain ing any paint thereon.

(I ) 111e licensee of any ba ke ry or any baker shall not kee p or " .. pi ......

permi t to be kept at a bakery, or in its immediat e precincts, a ny P<OI>it>,«I'ueI.

pt"ohibi ted scrap wooden ma terial, or any fuel Which had been used fo r

purposes other than the oooking o r bak ing of food . or any other fuel

which is othelWise prohibi ted under these regula tions.

(2 ) 111e pre5(: nce of any woode n materia l or prohibi ted fuel

inside or in the im mediate preci nts of a bakery shal l be deemed as if the

w\XXI or fuel was being kept by the licensee or by a ba ker for use as fuel

for cooking , baking or olher form of heat trea tment, unless he can pro~e

that he had take n adeq uat e steps to inform the pu blk that he no longe r

requested the supply ohuch w\XXI orfuel. that he had not actually taken

in or used such w\XXI or fuel at his bakery, Bnd that he had immediately

informed the Police authorities of his finding such wood or fue l in the

immediate precincts o f his bakery.

.5. No perso n may sell, offe r, expose . advert ise for sale, or supply

by way of compe nsat ion or ot herwise. any food whic h has been cooked,

bak ed or had any othe r fonn of hcallreatmcnt applied 10 it contrary to

the provisions of these regulations.
