PORTS ORDINANCE, 1%2 (ORDINANCE NO. XIII OF 1962)

Yachting Centn- (A,,",ndment) Regulations, 1988

IN exerci~e of the powers conferred by section 233 of the Code of

Police Laws, by ~et:lion 8 of tbe Port Dues Ordinance, and by sections

12.26.29 and 42 of tbe Pons Ordinance, the Ministe r for Development

of Teniary Sector, with the concu rrence of the Minister of Finance, has

made the following regulations:-

I. (I) These regulations may be cited as the Yachting Centre Ci .. ,ion."d

(Amendment) Regulations , 1988, and shall be read and construed as """' .... """ ..... "'-

These regulations shall come into force on tbe 1st April,

1988. 2, Tbe definition "ordinarily resident in Malta" in regulation 2 of

the principal regulations shall be deleted.

3, For the proviso to regulation 11 of the principal regulation ~

there shall be substituted the following

"Provided that the Director may , in bis discretion, allow that

craft, stores and supplies to yacbts be kept on a quay f';lr a Ii.mited

period of time ~ubject to the paymen t of a fee specified 10 the

Schedule hereto for crafts so authorised 10 be kept on a quay

Provided further that th e owners of any craft that is deposited

on the quay without the authority of the Director will automatically

become subject to the payment of LmS for every running metre or

pan thereof of overall length for every week or pan the reof without

prejudice 10 any other action which may be taken in terms of the

provisions of these regulations.".

For paragraph (I) of regulation 18 of the principal regula tions

there shall be substituted the following

"(1) Berthing or mooring space in a yachting centre may be

reserved by the Director for any yacht at the request of its owner or

master and upon the paymellt of a bookillg fee equivalem to olle

week 's berthing fees . Such a fee shall not be reimbursed ullder any

circumstances.
