Commission Agents (Licences) R~u lations. 1988

IN e~ eTcise o f tllc powers conferred by section 72 of the Commer-

cial Code, Ihe Presidentof Malta has m~de the followi ng regulations:-

(1) These regulations may be cited as the Comm issionCitotiOflond

Agents (Licences) Regulations, 1988.

These regulations shall come into force on the 1st .lanu-

ary, \989.

[n these regulatio ns. unless the context otherwise req uires _

"the Code" means the Commercial Code (Chapter 13); and

·'the Council" means the Council of th e Chamber of Com-

merce.

the Code shall be-

(i ) tlte sum of Lm 10 whiclt shall be payable on or before the

grant of tlte licence; and thereafter

(ii) the sum of LmIO (hereinafter called "the allnual fee")

which shall be payable on the 1st January in each year during the

currency of the licence.

If any annual fee payable under the preceding regulation on F.;I"", to

the 1st January in any year is not paid before the 1st February in tha11'<'1 1 «

year, Ihe Council shall, as soon afte r the 1st February as may be conve-

nient. address a communication to the person whose annual fee has not

so bee n paid drawing his attention to his fail ure to pay such fee, and the

Council shall be deemed to have complied with this regulation if such

communicatio n be sent pre·paid. by registered post. to th e usual or last-

known address of the person whose fee has not so been paid.

S. (I) If any ann ual fee is not paid within thirty days after the

dat e upon which the communication aforesaid has been sent by post, the I;"'""".

licence to which it relates sh all cease to be in force sine die, and if the

person to whom it was granted wishes again to act as acommission agent

he ~hall be required to apply for a new licence in accordan~e with the

provisions of section 71 of the Code.

(2) In considering unde r that sect ion any such appli cation

and the fitness of the applicant to act as a COmmission agent, theCou ncil

may tak e into consideration the previous failu re of the applkant to pay

the allnual fce and of any explanation regarding Ihat failure which the

applicant may add uce.

(3) When a licence ceases under Ihis regulation to be in
