Port ' "abQtJr (Dderminations) (A mend ment) O rder , 1987

IN exercise of the powers conferred by section 8 of the Port

Workers Ordinance, 1962, the Prime Minister has made the followi ng

I. This order may be cited as Ihe Port Labou r (Determinations)

(Amendment) Order, 1987, and shall be read and construed as one

with the Port Labour (Determinat ions) Order, 1966. herei nafter

referred to as "the principal order",

Fo r paragraph (2) of article 2 of the princi pal order there shall

be subst ituted the following

In this order. unless the conte"t otherwise

requi res -

"accompanied motor car" means a private motor

car accompa nied by a person travelling 10 or from Malta.

but shall not include a priva te motor car imported into

Mal ta for the first time by a residen l of Malta after a

visit abroad

"Govemment Silo" means the Govemmenl silo

situated at the Deep Water Quay at Pin to Road, Marsa

"Kordin Silo" means the grai n silo situated at

Magazine Wharf agai nst the seaward face of Kordin Hill;

"metric ton" means a ton of 1000 kilograms;

"tourist coach" means a motor coach accompanying

tourists on tou r to/from Malta, but shall not include a

motor coach imported into Malt a for the first time by a

resident of Malta after a visit abroad," ,

J. Immediate ly after Part III o f T ariff C in the First Schedule Am.ndo ....

to the principal order there shall be added the followi ng new Part:- to

1, Notwithstandin g anything con tained in this Tariff.

~:=' port workers employed to load or unload wheat in bulk or

"",,(b~ Silo, o the r bulk cargo through the Kordin Silo shall be paid the

fee of 2·5 cents pe r metric ton

Provided th at when wheat in bulk or other bulk

cargo is transferred from Kordin Silo to other silos or to

warehouses fo r local use or consumption, such wheat in bulk

or othe r bulk cargo shall be deemed to have been handled

at the Government Silo and the appropriate fees specified

in this Tariff sball be paya ble.

2. The fee of 2·5 cents per metrie ton shall be. deemed

to include all remuneration for all work that maybe necessary

for the whole loading or un loading operation."'.

For paragraph 2 of the Third Schedule to the princi pal order

there shall be substituted the following new paragraph:-

working hours of the port and on Sat urdays , Su ndays and

public h.olidays shall be considered as overtime work

Provided that work at the Kordin Silo by day gangs

after 5 p.m. and work by night gangs after 4 a,m. on all days

shall not be dee med to be overtime work.".

Immediately after sub·paragraph (7) of paragraph 3 of the

Fourth Schedule to the principal order there shall be added the

following new sub·paragraph

"(8) The provisions of sulrparagraphs (4) and (6)

of this paragraph shall not apply to the placi ng of orde rs for

port workers to load or unload bulk cargo at the Kordin

Silo, and for the allocation and payment of port workers for

such work.".
